About lobbying

This Law determines the legal basis of lobbying in Ukraine.

Section I. General provisions

Article 1. Determination of terms

1. In this Law terms are used in the following value:

1) the beneficiary - foreign state, the physical, legal entity or group of such persons in which commercial interests lobbying is performed;

2) the service provision agreement on lobbying (further - the agreement of lobbying) - the transaction made in writing according to which the subject of lobbying performs lobbying according to the customer order in commercial interests of the beneficiary;

3) the client - foreign state, the physical, legal entity or the group of such persons which signed the contract of lobbying with the subject of lobbying in the commercial interests or in commercial interests of other beneficiary;

Commercial interest - money or other property, personal advantages, privileges, other benefits of material or intangible nature which person will get or can receive 4) within implementation of economic activity after impact (impact attempt) on subject to lobbying as a result of adoption (edition) of the regulatory legal act, introduction in it of changes, loss of force (cancellation) by the regulatory legal act which is lobbying subject, or as a result of abstention from such actions;

5) conflict of interest during lobbying - contradiction between commercial interests of beneficiaries of the subject of lobbying, interests or the rights of the subject of lobbying and its obligations which availability can affect objectivity or impartiality of the subject of lobbying when implementing of lobbying by it;

6) lobbying - the activities performed for the purpose of impact (impact attempt) on subject to lobbying in commercial interests of the beneficiary (for the reward earned directly or indirectly, and/or with payment of the actual expenses necessary for its implementation) or in own commercial interests of person and concerning lobbying subject;

7) subject to lobbying subject of law-making activities (except the Ukrainian people on All-Ukrainian referendum, territorial community on local referendum) and/or the subject of law-making initiative;

8) lobbying subject - the regulatory legal act, concerning planning of development, development and/or acceptance (edition) of which, modification of which, loss of force (cancellation) by which (or abstention from such actions) the subject of lobbying performs influence (impact attempt) on subject to lobbying;

9) the subject of lobbying - the physical person or legal entity performing lobbying on the bases and according to the procedure provided by this Law;

10) the sphere of lobbying - the sphere of the public relations in which the subject of lobbying plans implementation or performs lobbying.

2. The terms "final beneficial owner" and "essential participation" are used in this Law in the values given in the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction".

3. Other terms are used in this Law in the values given in the laws of Ukraine "About law-making activities", "About media", "About public associations", "About prevention of corruption", "About personal data protection" and other regulatory legal acts.

Article 2. The legislation in the sphere of lobbying

1. The relations arising in the sphere of lobbying are regulated by the Constitution of Ukraine, this Law, international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine, and other regulatory legal acts adopted according to them.

2. Changes can be made to this Law only by the laws on introduction of amendments to the Law of Ukraine "About lobbying".

Article 3. Law coverage

1. Operation of this Law extends to the relations arising during lobbying.

2. The activities which are not containing all signs of lobbying, in particular are not lobbying according to this Law:

1) representation of foreign policy interests bodies of diplomatic service;

2) popular initiative on All-Ukrainian referendum and initiative on local referenda;

3) activities of subjects in the sphere of media and electronic communications;

4) the activities of political parties and local organizations of political parties, activities of candidates for elective offices at election of the president of Ukraine, elections of People's Deputies of Ukraine and local elections connected with their participation in the electoral process of the corresponding elections;

5) activities of associations of local government bodies;

6) scientific and scientific and technical activities;

7) the activities connected with attraction, use, monitoring of provision and use of the international technical assistance, projects implementation and programs of the international technical assistance;

8) the activities of public associations, other non-profitable companies, organizations and organizations directed to impact (impact attempt) on subjects of powers of authority (public authorities, other state bodies, local government bodies, the legal entities of the public law given powers of authority, their officials) for the purpose of acceptance or abstention from acceptance by such subjects of the decisions carried to their powers except cases if such activities concern commercial interests;
