Based on Item 4-1 of the Presidential decree of the Republic of Belarus of December 31, 2015 "About provision of housing and communal services" the Ministry of Housing and Public Utilities of the Republic of Belarus DECIDES: No. 535

1. Approve the Instruction about procedure for expense recovery for the electric power consumed on lighting of auxiliary rooms and operation of the equipment, including elevators it (is applied).

2. This resolution becomes effective after its official publication and extends the action to the relations which arose since January 1, 2024.

Chapter 1. General provisions

1. This Instruction determines procedure for compensation for the account of means of local budgets of expenses of the organizations performing operation of housing stock and (or) providing housing and communal services (further – the organizations), on the electric power consumed on lighting of auxiliary rooms and operation of the equipment, including elevators in the apartment apartment houses (further – expenses on the electric power) which are not compensated by payers of housing and communal services.

2. Expense recovery for the electric power is performed based on relevant decisions of local executive and administrative organs.

Chapter 2. Procedure of payments of the size of funds of local budgets for expense recovery for the electric power

3. Actually incurred expenses of the organizations on the electric power in the part which is not covered by the payments added to payers of housing and communal services in connection with use of the maximum permissible amount of compensation of such expenses (are subject to compensation from local budgets in case of their establishment according to the legislation).

At the same time compensation of the above-stated expenses is performed in full, but not above the extreme size of costs determined according to Items 9, of the 10th this Instruction and approved city (the cities of regional subordination), by district executive committees on each apartment apartment house, for Minsk – local administrations of areas on each apartment apartment house.

Limiting review of the size of costs after its approval is allowed in cases of change of rate for electrical energy, and also changes of contractual size of active capacity in view of replacement of the electroconsuming all-house equipment made based on the developed project documentation then these extreme sizes of costs are subject to approval according to the procedure, established by part two of this Item.

4. Determination of actually incurred expenses of the organizations on the electric power specified in part two of Item 3 of this Instruction is performed:

in the presence of metering devices of expense of the electric power and in case of non-accounting electric power consumption – according to the procedure, the determined Regulations on procedure of payments and introduction of payment for housing and communal services and payments for use of premises of the state housing stock, and also expense recovery for the electric power approved by the resolution of Council of Ministers of the Republic of Belarus of June 12, 2014 No. 571;

in cases when installation of metering devices of expense of the electric power is economically inexpedient or is technically impossible, – proceeding from requirements of the Rules of electric utility service approved by the resolution of Council of Ministers of the Republic of Belarus of October 17, 2011 No. 1394.

In case of non-accounting electric power consumption, including in the absence of the electric power expense metering device in connection with removal of the metering device on the state checking, over three months expense recovery of the organizations for the electric power from local budgets is not performed.

The cost of the consumed electric power shown by the power supplying organization for payment to the organization in cases of unauthorized (free-lance) and its non-accounting consumption, except as specified, of this Item, and also penalty provided by part one and the second is not compensated from local budgets.

5. The sizes of funds of local budgets for expense recovery for the electric power are planned and allocated to the organizations from the budget of that administrative and territorial unit (the area (the city of regional subordination), administration of the area in Minsk) in the territory of which apartment apartment houses are located.

6. The need for funds of local budgets for expense recovery for the electric power is determined by the organization for each apartment house based on calculation of need for means of local budgets for form according to appendix and no later than the 25th following reporting it is provided in local financial bodies of the corresponding administrative and territorial unit.

Financing of expenses of the organizations on the electric power is performed by local financial bodies of the corresponding administrative and territorial unit monthly no later than the last date following reporting.

7. The calculations for expenses on the electric power in the expired year which remained unfinished for January 1 of the next financial year are made in the next financial year due to budget settings on the same purposes.

8. The amount of funds of local budgets for expense recovery of the organizations for the electric power is determined as difference between actual expenses (but not above the extreme size of electricity costs) and the added payment amount from the population for the electric power according to the legislation.

Chapter 3. Limiting procedure of payments of the size of costs

9. The extreme size of costs for lighting of auxiliary rooms and operation of the equipment, except for elevators, it is determined by formula
