About some questions of transportation of the liquefied oil gas

According to article 18 of the Law of the Republic of Kazakhstan "On regulation of trading activity" and article 29 of the Agreement on the Eurasian Economic Union (further - the Agreement), and also Section 10 of Appendix 7 to the Agreement, I ORDER:

1. Impose export ban from the territory of the Republic of Kazakhstan of the liquefied oil gas (code of the CN FEA EEU 2711 12 970 0), propane (code of the CN FEA EEU 2711 12 940 0) and butane (code of the CN FEA EEU 2711 13 970 0) automobile and by rail for a period of six months, except for:

1) export by the subsoil users who performed production within the agreement (contract) on the Section of products or the contract subsurface use approved by the President of the Republic of Kazakhstan, having stability of tax regime according to Item 1 of article 722 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax the code);

2) commodity exportation, made (processed) of the Kazakhstan raw materials extracted on the Karachaganak field based on international treaties of the Republic of Kazakhstan;

3) the moved transit transportations which are beginning and coming to an end outside the Republic of Kazakhstan.

2. To provide to department of the gas industry of the Department of Energy of the Republic of Kazakhstan the notification of Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan and the Border service of Committee of homeland security of the Republic of Kazakhstan on acceptance within the competence of necessary measures for ensuring execution of Item 1 of this order of the procedure established by the legislation of the Republic of Kazakhstan.

3. To provide to department of the gas industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten calendar days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item;

4) informing the Eurasian economic commission on introduction of the prohibition specified in Item 1 of this order.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective since May 14, 2024 and is subject to official publication.
