Rules of provision of lump money payment on acquisition or construction of premises or premises in property to free of charge separate categories of the citizens of the Russian Federation living in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region

I. General provisions

1. These rules determine:

a) procedure for accounting as persons in need in premises (further - accounting) the citizens called in Item 1 of the Presidential decree of the Russian Federation of June 6, 2023 No. 418 "About housing ensuring separate categories of the citizens of the Russian Federation living in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region" (further respectively - citizens, the Decree), and the bases of removal of citizens from accounting;

b) procedure of payments of the size and provision of lump money payment on acquisition or construction of premises (further - lump sum payment);

c) procedure for provision of premises in property free of charge;

d) payment procedure of the total area of premises exceeding regulation of provision of the area of premises in the property free of charge established by Items 7, 8 and 11 Decrees (further - the total area of premises exceeding provision regulation).

2. According to the Decree citizens are accepted on accounting by executive bodies of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region (further - executive bodies of subjects of the Russian Federation) at the place of residence which is understood as the place of permanent residence confirmed with mark in the passport of the citizen of the Russian Federation about registration at the place of residence in the territory of appropriate subject of the Russian Federation.

3. Priority form of providing citizens with premises is provision of lump sum payment by it.

4. Lump sum payment is provided to the citizen within budgetary appropriations, to the provided budgets of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region for the purpose of implementation of delegated powers of the Russian Federation on providing citizens with premises according to the Decree.

5. According to solutions of management officials of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region (further - the management official of the subject of the Russian Federation) premises in property free of charge can be provided to citizens according to the Decree.

6. Petitions from citizens about acceptance on accounting or about removal from accounting, other statements and the documents filed and represented by citizens and members of their families according to these rules can move them in executive body of the subject of the Russian Federation:

a) personally;

b) by the method allowing to determine the fact and date of their direction and receipt of the subject of the Russian Federation by executive body. In this case signatures of the citizen and full age members of his family shall be certified of the notarial or established by the legislation of the Russian Federation other procedure;

c) through the representative. In this case the power of attorney confirming availability of powers on representation of interests of the citizen and (or) members of his family, certified in the notarial or established by the legislation of the Russian Federation other procedure and the copy of the identity document of the representative shall be enclosed to the application;
