About approval of the Regulations on procedure for determination of the minimum size of compulsory contributions or payments for content, operation and repair of common property in apartment houses, and also improvement of the parcel of land adjacent to the apartment house

According to the Law of the Republic of Uzbekistan "About management of apartment houses", the resolution of the President of the Republic of Uzbekistan of August 15, 2023 "About measures for the further effective organization of management of apartment houses" I ORDER to No. PP-278:

1. Approve Regulations on procedure for determination of the minimum size of compulsory contributions or payments for content, operation and repair of common property in apartment houses, and also improvement of the parcel of land adjacent to the apartment house, according to appendix.

2. This order is approved with the Ministry of Economics and finance, Committee on development of the competition and consumer protection, Comissioners for the President of the Republic of Uzbekistan on protection of the rights and legitimate interests of subjects of entrepreneurship and Chamber of Commerce and Industry of the Republic of Uzbekistan.

3. This order becomes effective from the date of its official publication.

Regulations on procedure for determination of the minimum size of compulsory contributions or payments for content, operation and repair of common property in apartment houses, and also improvement of the parcel of land adjacent to the apartment house

This Provision determines procedure for determination of the minimum size of compulsory contributions or payments (further - compulsory contributions or payments) for content, operation and running repair of common property in apartment houses, and also improvement of the parcel of land adjacent to the apartment house, (further - content of apartment houses).

Chapter 1. Structure of costs in case of determination of the minimum size of compulsory contributions or payments

1. The costs used in case of determination of the minimum size of compulsory contributions or payments are:

a) the costs connected with accomplishment of services in the minimum list of the services and works necessary for ensuring content of apartment houses at the necessary level specified in appendix to this Provision;

b) the costs connected with management of the apartment house:

on compensation of administrative personnel and employees of the body exercising control of the apartment house of body (further - managing body);

content and servicing of the technical, communication and information and communication means of managing body necessary for management of the apartment house;

payment of the rent of buildings and rooms for administrative needs of managing body;

compulsory insurance of staff of managing body;

commission fee when implementing the payments connected with management of apartment houses through commercial banks and electronic payment systems, for transfer of these payments;

advanced training of staff of managing body.

Chapter 2. Calculation of the minimum size of compulsory contributions or payments for content of the apartment house for 1 square meter of the area

2. The minimum size of compulsory contributions or payments for content of the apartment house for 1 square meter of the area is calculated by the following formula:

B3 - the minimum size of compulsory monthly fee or payment for 1 square meter of total area of the residential and non-residential premise in the apartment house;

 3501-2  - the amount of the annual planned expenses, stipulated in Item 1 this provision;  

3501-3 - the planned necessary amount of profit (this amount is considered only if the management company or the managing director manages the apartment house).

At the same time the size of the planned necessary profit of the management company or the managing director received from their activities is approved on general meeting of owners of residential and non-residential premises in the apartment house (further - owners of rooms) and affirms the decision of general meeting;

3501-4 - other sources of the income and receipts directed to covering of total costs (without receipts from compulsory contributions of owners of rooms), including:  

the means arriving from lease of basements and from lessees of other common property of apartment houses. At the same time utility payments of lessees are conducted separately and shall not join in costs of compulsory contributions;

the funds allocated from additional sources of the budget of the Republic of Karakalpakstan, local budgets of areas and the city of Tashkent, budgets of areas and the cities for capital and running repair of the apartment house and improvement of the parcel of land, adjacent to the house, the funds allocated for the projects declared as the winners within the Initiative Budget project and also the funds allocated from fund of support of the Ministry of Construction and Housing and Communal Services of the Republic of Uzbekistan;

means of legal entities and physical persons in the form of the sponsor's and charitable help;

the assignments provided to governing body from the funds raised for utilities based on agreements on assistance assembled of the payments for utilities from owners of rooms signed by governing body with the organizations of public service;

the excessive means after expenses of managing body received from compulsory contributions or payments of owners of rooms in the previous accounting period;

the means which arrived from other sources which are not prohibited by acts of the legislation;

3501-5 - total area of residential and non-residential premises in the apartment house.  

3. The average size of monthly compulsory contribution or payment for 1 square meter of the area of the apartment houses which are in management of managing body is determined by the following formula:
