About the state control of implementation of the international motor transportations and about responsibility for violation of procedure for their accomplishment

This Federal Law determines the legal basis of measures for strengthening of the state control of observance of procedure of the international motor transportations by the territory of the Russian Federation by the cargo vehicles or by buses belonging to both the Russian, and foreign carriers, responsibility for violation of the procedure established by this Federal Law, and also the rights and responsibility of bodies and their service employees, representatives to carry out control of observance of procedure of the international motor transportations.

Article 1

For the purpose of this Federal Law the following basic concepts are used:

the cargo vehicle - the driverless vehicle intended for carriages of goods or the driverless vehicle with trail car or semitrailer truck;

the Russian carrier - the Russian legal entity or the individual entrepreneur using one or several cargo vehicles and (or) one or several buses belonging to them (further - vehicles) for carriages of goods or passengers;

foreign carrier - the foreign legal entity or physical person using the vehicle belonging to it for carriages of goods or passengers;

the international motor transportation - transportation by the vehicle of loads or passengers on the territories of two and more states, and also driving of not loaded vehicle through the territories of two and more states;

bilateral international motor transportation - transportation by the vehicle belonging to the Russian carrier from the territory of the Russian Federation on the territory of foreign state or from the territory of foreign state on the territory of the Russian Federation, and also transportation by the vehicle belonging to foreign carrier from the territory of foreign state in which the specified vehicle, on the territory of the Russian Federation or from the territory of the Russian Federation on the territory of this foreign state is registered;

transit international motor transportation - transportation by the vehicle belonging to the Russian carrier from the territory of one foreign state on the territory of other foreign state en route through the territory of the Russian Federation or from the territory of the Russian Federation on the territory of the Russian Federation transit across the territory of foreign state, and also transportation by the vehicle belonging to foreign carrier, en route through the territory of the Russian Federation;

the international motor transportation from the territory or on the territory of the third state - transportation of one foreign state by foreign carrier on the territory of the Russian Federation from the territory of other foreign state or from the territory of the Russian Federation on the territory of other foreign state;

regular passenger international motor transportation - public conveyance by bus on in advance approved rout to follow with indication of starting point of transportation and terminal point of transportation, stopping points of movement of the bus and the schedule of its movement;

irregular passenger international motor transportation - the public conveyance by bus which is not regular passenger international motor transportation;

the large-size vehicle - the vehicle which dimensions with load or without load exceed the admissible dimensions established by the Government of the Russian Federation, or dimensions, established by the decision on temporary restriction of movement of vehicles made based on Item 2 of part 1 of article 30 of the Federal Law of November 8, 2007 No. 257-FZ "On highways and on road activities in the Russian Federation and on modification of separate legal acts of the Russian Federation" in case of decrease in bearing capacity of structural elements of the highway, its sites or change of dimension of approach of the highway, its sites;
