For the purpose of implementation of the Agreement between the Government of the Republic of Belarus and the Government of the Russian Federation about interaction in the field of ensuring transport safety of February 19, 2021 and in pursuance of article 3 of the Law of the Republic of Belarus of December 27, 2021 "About ratification of the Agreement between the Government of the Republic of Belarus and the Government of the Russian Federation about interaction in the field of ensuring transport safety" the Council of Ministers of the Republic of Belarus DECIDES: No. 136-Z

1. Approve Regulations on requirements to the owner of infrastructure of rail transport public and to carriers on ensuring transport safety of infrastructure facilities of rail transport public and vehicles of rail transport it (is applied).

2. This resolution becomes effective in three months after its official publication.

Regulations on requirements to the owner of infrastructure of rail transport public and to carriers on ensuring transport safety of infrastructure facilities of rail transport public and vehicles of rail transport

Chapter 1. General provisions

1. This Provision determines requirements for ensuring transport safety of infrastructure facilities of rail transport public (further - infrastructure facility) and vehicles of rail transport, obligatory for accomplishment by the owner of infrastructure of rail transport public (further - the owner of infrastructure) and carriers.

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus of January 6, 1999 No. 237-Z "About rail transport" and also the following terms and their determinations are used:

the act of illegal intervention - the illegal action (failure to act) which is menacing to safe activities of rail transport, entailed damnification of life and to human health, material damage or created threat of approach of such effects;

ensuring transport safety - realization of system of legal, economic, organizational and other measures in the field of transport safety of infrastructure facilities and vehicles of rail transport;

bodies of reaction - the state security agencies, law-enforcement bodies, the Presidential Security Service of the Republic of Belarus, bodies of the border service, Armed Forces of the Republic of Belarus and internal troops of the Ministry of Internal Affairs, bodies and divisions on emergency situations;

technical means of ensuring transport safety - system and means of the alarm system, access control, examination, video surveillance, audio-and videos, bonds, notifications, collection, processing, acceptance and information transfer, held for use on infrastructure facilities and in vehicles of rail transport for the purpose of ensuring transport safety of infrastructure facilities and vehicles of rail transport;

transport safety of infrastructure facilities - condition of security of infrastructure facilities from acts of illegal intervention;

transport safety of vehicles of rail transport - condition of security of vehicles of rail transport from acts of illegal intervention;

authorized persons of bodies of reaction - the staff of the state security agencies, law-enforcement bodies, the Presidential Security Service of the Republic of Belarus, bodies of the border service, the military personnel of Armed Forces of the Republic of Belarus and internal troops of the Ministry of Internal Affairs, employees of bodies and divisions for emergency situations;

evacuation - organized exit (export) of people from zone of the predicted or committed act of illegal intervention and their temporary placement in the safe area (zone).

3. Requirements for ensuring transport safety are determined proceeding from the following levels of transport safety of infrastructure facilities and vehicles of rail transport:

level No. 1 - permanent level in the absence of information based on which the decision on establishment of more high level of transport safety of infrastructure facilities and vehicles of rail transport (further - No. level 1) can be made;

level No. 2 - the level in case of which there is unconfirmed information on threat of making of the act of illegal intervention (further - No. level 2);

level No. 3 - the level in case of which there is the confirmed information on threat of making or on making of the act of illegal intervention, including on detection of tools and (or) means of its making, identification of the terrorist or extremist activities connected with preparation for making or with making of the act of illegal intervention (further - No. level 3).

4. Level No. 2 and level No. 3 of transport safety of infrastructure facilities and vehicles of rail transport are established according to the decisions of law-enforcement bodies made within competence of these bodies according to information on threat of making or on making of the act of illegal intervention which is available for them.

Chapter 2. Requirements for ensuring transport safety of infrastructure facilities

5. Requirements for ensuring transport safety of infrastructure facilities in case of level No. 1 are:

purpose of the faces responsible for ensuring transport safety on infrastructure facilities, determination of their job responsibilities;

availability of organizational and administrative documents on ensuring transport safety on infrastructure facilities;

the equipment of infrastructure facilities technical means of ensuring transport safety, exception of access for strangers to elements of control of these technical means and storages arriving from the specified technical means of information, maintenance of communicating device in permanent readiness;

ensuring safety on infrastructure facilities of stock and instruments of strict accounting;

ensuring control of observance on infrastructure facilities physical persons and the owner of infrastructure of the rules of stay and placement of objects established by the legislation on transport activities in zones of the increased danger, accomplishment in these zones of works, journey and transition through railway tracks;

carrying out infrastructure by the owner independently and with participation of law-enforcement bodies or state security agencies of doctrines and trainings with frequency at least once in five years;

assistance to law-enforcement bodies in activities for protection of public order and to ensuring public safety on infrastructure facilities;

carrying out by the owner of infrastructure of surveys of devices of railway track, alarm system, centralization and blocking, electric utility service, territory of other infrastructure facilities;
