1. Approve the enclosed Rules of forming of the list of priority farm vehicles and the equipment.

2. To provide to committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet - resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming of the list of priority farm vehicles and equipment

Chapter 1. General provisions

1. These rules of forming of the list of priority farm vehicles and the equipment (further - Rules) are developed in compliance with the subitem 224) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864 "Some questions of the Industry ministry and construction of the Republic of Kazakhstan" and determines procedure for forming of the list of priority farm vehicles and the equipment.

2. In these rules the following concepts are used:

1) the agricultural equipment (further - the equipment) - the equipment intended for mechanization, to electrification and automation of agricultural works of which owing to specifics of its operation the immovability of Basic and case Elements of design, rather bearing area, during execution of engineering procedures is characteristic;

2) the farm vehicle (further - the machine) - the self-propelled agricultural machinery, trailed and mounted implements intended for mechanization of agricultural works (in agriculture and livestock production) of which mobility of Basic and case Elements, rather bearing area, during execution of engineering procedures is characteristic;

3) the agreement on industrial assembly of agricultural machinery with legal entities of the Republic of Kazakhstan (further - the agreement) - grazhdansko - the legal instrument signed between authorized body in the field of the state stimulation of the industry and the legal entity of the Republic of Kazakhstan performing production of agricultural machinery according to the civil legislation of the Republic of Kazakhstan and international treaties ratified by the Republic of Kazakhstan;

4) the certificate of origin of form "CT-KZ - the document testimonial of the country of goods' origin, the status of goods of the Eurasian Economic Union or foreign goods;

5) the applicant - person intending to include actually made farm vehicle and the equipment in the list of priority farm vehicles and the equipment (further - the List).

3. Are included in the List:

1) farm vehicles and the equipment by codes of the commodity nomenclature of foreign economic activity of tractors, combine harvesters and forage-harvesters in case of availability of the current agreement;

2) farm vehicles and the equipment, except for codes of the commodity nomenclature of foreign economic activity of tractors, combine harvesters and forage-harvesters, in case of availability of the existing certificate of origin of the CT-KZ form.

4. The list is created by Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan (further - Committee) and affirms the order of the Minister of Industry and construction of the Republic of Kazakhstan, according to the subitem 225) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864 "Some questions of the Industry ministry and construction of the Republic of Kazakhstan".

Chapter 2. Procedure for forming of the list of priority farm vehicles and equipment

5. The applicant for turning on of the made farm vehicle and (or) the equipment in the List submits in paper and (or) electronic form the request to Committee with appendix:

1) the list of the made farm vehicles and the equipment in the state and Russian languages in form, according to appendix 1 to these rules;

2) the current agreement for agricultural machinery by codes of the commodity nomenclature of foreign economic activity of tractors, combine harvesters and forage-harvesters or the existing certificate of origin of the CT-KZ form for agricultural machinery, except for codes of the commodity nomenclature of foreign economic activity of tractors, combine harvesters and forage-harvesters.
