According to part three of article 12 of the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for functioning of the enclosed State system of online monitoring.

Procedure for functioning of the State system of online monitoring

General questions

1. This Procedure determines the mechanism of functioning, operation, technical maintenance, the list of users of the State system of online monitoring (dalee-Gosudarstvennaya system) and amount of access rights for various users of the State system, order of interaction of the State system, organizers of gamblings and the Commission on regulation of gamblings and lotteries (further - authorized body).

2. In this Procedure terms are used in the following value:

authentication - the electronic procedure which allows to confirm electronic identification of the user of the State system and/or online system of the organizer of gamblings (further - online system);

authorization - the electronic procedure of establishment of level of access rights to the State system;

the analytical report result of generalization of data which is created by the State system by certain criteria according to this Procedure;

gross income of the organizer of hazardous games amounts of the means received in cash and/or non-cash form in cash desk and/or into accounts of the organizer of gamblings from players in gamblings it is reduced by the amount (cost) of the paid (issued) players during corresponding accounting period prizes (prizes) in such gamblings and returned rates;

electronic office of the administrator/user of the State system part of the State system by means of which the administrator/user of the State system performs necessary actions in the limits determined by the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings" (further - the Law) and this Procedure;

request for remote shutdown requirement to the organizer of gamblings about remote shutdown of gaming machines through its online system with use of the corresponding application programming interface;

subsystem - component of the State system;

the rights of access permission to accomplishment of certain set of actions which the user of the State system has the right to carry out in the State system taking into account differentiation of the rights of users of the State system;

registers of organizers of hazardous games sets of registers which includes:

- The register of organizers of gamblings in gambling institutions of casino;

- The register of organizers of gamblings of casino on the Internet;

- Register of organizers of bookmaker activities;

- The register of organizers of gamblings in slot machine halls;

- The register of organizers of game in poker on the Internet;

the unique identifying sign of object in the State system which unambiguously determines object among other objects of the same type is created and provided in special type.

Other terms are used in the value given in the Laws of Ukraine "About state regulation of activities for the organization and carrying out gamblings", "About electronic confidential services" and "About information security in information and communication systems".

3. The state system is conducted in state language and functions round the clock in real time.

The state system shall have the certificate of conformity of the Ukrainian and/or foreign laboratory determined according to the Law authorized body.

4. Subjects of the State system are:

1) holder of the State system;

2) administrator of the State system;

3) users of the State system.

5. The owner and the holder of the State system is the state on behalf of authorized body.

Owner of information and the administrator of the State system is the authorized body.

6. Authorized body:

Unrestricted access to all information which is stored in the State system and also to not personalized data of players in the State system on the Internet online, except the Register of persons which limits access to gambling institutions and/or participation in gamblings in which information is personified has 1);

2) grants access rights to the State system to users of the State system according to this Procedure;

3) makes management decisions of rather further development and enhancement of the State system;

4) exercises control of observance by users of the State system of requirements of the legislation for use of the state information resources;

5) is performed by methodical and methodological ensuring functioning of the State system;

6) is carried out by systematic monitoring and efficiency analysis of functioning of the State system;

Provides 7):

creation, upgrade, administration and functioning of the State system, implementation of complex system of information security with the confirmed compliance;

information security from loss, plunders, misstatements, counterfeits, unauthorized actions for its destruction, modification, copying and so forth;

implementation of collection, accumulating, the analysis and storage of information in the State system;

information security from unauthorized access on the Internet;

uninterruptedness of functioning of the State system;

preserving information processed in the State system;

sending request for remote shutdown of gaming machines;

8) carries out permanent monitoring of technical condition of the State system;

Finds 9) and fixes technical failures in work of the State system;

Reveals 10) and fixes violations of uninterruptedness in interaction of the State system with the gambling equipment, including online systems;

11) performs other actions connected with ensuring functioning of the State system.

7. Users of the State system are:

authorized officers of authorized body with the right of unrestricted access to all information which is stored in the State system and also to not personalized data of players in the State system on the Internet online, except the Register of persons which limits access to gambling institutions and/or participation in gamblings in which information is personified;
