About mobilization preparation and mobilization in Turkmenistan

This Law determines the legal basis of mobilization preparation and mobilization as component of the organization of defense of neutral Turkmenistan, establishes powers, obligations and responsibility of state governing bodies, local government bodies, companies, organizations, organizations, officials and citizens in implementation of mobilization actions.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following concepts are used:

mobilization preparation - the complex of the nation-wide events held in peace time, including advance preparation of state governing bodies and local government bodies (further - state bodies), the companies, organizations, the organizations, Armed Forces and other troops, the population and the territory of Turkmenistan for the purpose of protection of the state against armed attack and ensuring smooth operation of economy of the state during mobilization and in wartime;

mobilization - complex of the nation-wide actions connected with transfer of state bodies, companies, organizations, organizations, Armed Forces and other troops, the populations, the territories and economies of Turkmenistan on the mode of warlike situation (general mobilization) or their any part (partial mobilization).

Article 2. The legislation in the field of mobilization preparation and mobilization

The legislation of Turkmenistan in the field of mobilization preparation and mobilization is based on the Constitution of Turkmenistan, Basic provisions of the military doctrine of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan.

Article 3. Basic principles of mobilization preparation and mobilization

The basic principles of mobilization preparation and mobilization are:

1) obligation of carrying out mobilization preparation;

2) advance time, planned character and security of the planned actions;

3) centralized management of the organization and holding the planned actions;

4) complexity and interconsistency of industry and territorial actions;

5) control of the organization and holding mobilization actions.

Article 4. Content of actions for mobilization preparation and mobilization

Actions for mobilization preparation and mobilization include:

2) preparation of the territory, economy of Turkmenistan and determination of operating conditions of state bodies, companies, organizations, organizations during mobilization and in wartime;

5) the organization of military accounting in state bodies, at the companies, in organizations, the organizations;

6) booking of the citizens staying in inventory behind state bodies, the companies, organizations, the organizations for ensuring their smooth operation in wartime;

7) preparation of the special forming intended in case of the announcement of mobilization for transfer to Armed Forces and other troops or uses in their interests and also for the benefit of economy of Turkmenistan;

8) preparation of the equipment intended in case of the announcement of mobilization for transfer to Armed Forces and other troops or uses in their interests;

9) creation of reserve control centers of state bodies, companies, organizations, organizations and their preparation for work in the conditions of wartime;

10) conducting exercises and trainings on mobilization expansion and accomplishment of mobilization plans;

11) training of citizens on military specialties for completion of Armed Forces and other troops in case of mobilization;

12) creation, development and preserving mobilization capacities and objects for production of goods and products necessary for requirements satisfaction of the state, Armed Forces and other troops, the population in wartime;

13) creation, accumulating, preserving and updating of inventories of material values of the mobilization and not reduced state reserve;

14) assessment of condition of mobilization readiness of Turkmenistan;

15) advanced training of employees of mobilization bodies;

16) preparation of mass media for work during mobilization and in wartime;

17) carrying out mobilization of Armed Forces and other troops;

18) transfer of state bodies, companies, organizations, organizations into operating mode in the conditions of wartime;

19) the organization of the normalized supply of the population food and nonfoods, its medical attendance, providing with means of communication and vehicles during mobilization and in wartime;

20) international cooperation for the benefit of the solution of tasks of mobilization preparation and mobilization.

Chapter II. Powers of the President of Turkmenistan and state bodies in the field of mobilization preparation and mobilization

Article 5. Powers of the President of Turkmenistan

President of Turkmenistan:

1) determines the main activities in the field of mobilization preparation and mobilization;

2) issues decrees, resolutions and orders concerning mobilization preparation and mobilization;

3) is provided by interaction and the approved functioning of state bodies in the field of mobilization preparation and mobilization;

4) considers annual reports of the Cabinet of Ministers on condition of mobilization readiness of Turkmenistan;

5) in case of aggression against Turkmenistan or direct external safety hazard of the state makes orders about general or partial mobilization;

6) sets working hours of state bodies, companies, organizations, organizations during mobilization and in wartime;

7) also wartime resolves issues of provision of the right to draft deferment on military service during mobilization;

8) conducts negotiations and signs the international contracts and agreements on cooperation in the field of mobilization preparation and mobilization;

9) performs other states of power, necessary for protection, concerning mobilization preparation and mobilization.

Article 6. Powers of Majlis of Turkmenistan

Majlis of Turkmenistan performs the powers concerning mobilization preparation and mobilization according to the legislation of Turkmenistan.

Article 7. Powers of the Cabinet of Ministers of Turkmenistan

Cabinet of Ministers of Turkmenistan:

1) is provided by carrying out single state policy in the field of mobilization preparation and mobilization;

2) at the request of the President of Turkmenistan determines powers central and local executive bodies, directs their activities in the field of mobilization preparation and mobilization;

3) will organize development and accomplishment of mobilization plans;
