About energy saving and energy efficiency

This Law governs the public relations in the field of energy saving and energy efficiency, determines procedure for use of fuel and energy resources and products.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

- energy saving - rational use and reducing losses in production process, transformations, transportations and energy consumptions;

- alternative types of fuel - variety of the types of fuel (the liquefied gas, biogas, generating gas, biomass conversion products, water coal fuel and others) used for the purpose of reducing or substitution of consumption of primary more expensive fuel and energy resources and scarce types of energy;

- renewable energy resources - the different sources existing constantly, not relating to the got fuel types which periodically arise in the environment of flows of the sun, wind, geothermal waters, biomass and the rivers;

- energy efficiency - economically reasonable effective use of energy resources taking into account extent of development of the existing equipment and technology, with respect for requirements of environment protection, achievement of effective use of fuel and energy resources;

- energy efficiency indicator - determination of relative or absolute measure of the actual consumption or loss of fuel and energy resources for products (works, services) of any appointment in comparison with the regulations established by state standards;

- non-productive expense of energy resources - the non-compliance with expense of fuel and energy resources connected with the requirements established by state standards or other regulations, production schedules and passport data of the operative equipment;

- losses of resources and fuel and energy products - difference between the consumed and effective use of quantity of fuel and energy resources and products at each stage of their transfer, transportation, transformation and consumption, and also loss as a result of their irrational use;

- conditional fuel - accounting unit of organic fuel for comparison of different types of fuel on thermolysis with heat of combustion of equal 7000 kcal/kg;

- standard rates of losses - the wastage rate of fuel and energy resources and products, from the total established their quantity specified in regulating documents and passports of the equipment or approved in accordance with the established procedure;

- fuel and energy resources - set of all types of fuel, the natural and transformed energy of the country;

- secondary energy resources - the energy carriers received in the form of production wastes and consumption or by-products as a result of implementation of engineering procedure or use of the equipment which functional purpose is not connected with production of the corresponding type of energy resources;

- the energy passport - the regulated regulating document in which by results of energy research the actual indicators of energy efficiency and possibility of saving of energy resources are stated;

- the energy research (energoauidit) - data collection and processing about use of fuel and energy resources for the purpose of receipt of reliable information about amount of the used energy resources, about indicators of energy efficiency, identification of opportunities of energy saving and increase in energy efficiency with reflection of the received results in the energy passport;

Article 2. The legislation of the Republic of Tajikistan in the field of energy saving and energy efficiency

The legislation of the Republic of Tajikistan on energy saving and energy efficiency is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

Article 3. Coverage of this Law

1. Operation of this Law is applied to the following types of activity:

- production of fuel and energy resources and products the organizations, irrespective of organizational and legal forms;

- implementation of monitoring and stimulation of effective use of fuel and energy resources and products in the course of production, production, conversion, storage, transportation, transformation, distribution and consumption;
