Chapter I. General provisions

Article 1. Subject of the law

(1) This law establishes the legal basis for organization, the organization and functioning of National fund of culture, for assessment and selection of the projects which are subject to financing at the expense of means of this fund.

(2) the National fund of culture is created for financing of cultural, publishing projects and projects on protection and development of monuments.

Article 2. Law purpose

The purposes of this law are:

a) support and promotion of art creativity - financial support of the professional workers in the field of culture involved in art creativity;

b) ensuring residence and development of cultural and art mobility - financial support of professional workers in the field of culture and creativity for development of traditional and new forms of art mobility, including for strengthening of potential in this sphere, and also for creation of new employment opportunities;

c) development of management skills - financial support for development of competences, including in planning, budget management, leadership, communication etc.;

d) development of creative and technical skills - financial support for the organization of training for the purpose of enhancement of creative and technical skills experimentally and by means of development of special knowledge and specialized experience;

e) development of products, services and infrastructure - financial support in the course of creation and start of new product or new service or restart existing product, service or infrastructure;

f) industry interaction and creation of networks - financial support of cooperation between the organizations of the cultural sphere and possibility of consolidation of professionals and teams for development, distribution or use of special knowledge;

g) support of cultural pluralism - stimulation of cultural creativity for the purpose of development of cultural pluralism in the relations between different cultural groups of society;

h) support of development of potential and institutional capacity of receivers of financing;

i) support in development of the works of art or products promoting social unity;

j) support of protection and development of monuments - the financial support provided for the purpose of ensuring identification, research, documentation, inventory count, classification, accounting, digitization, promotion, establishment of the conservation zone, prevention of destruction or deformation, designing and implementation of interventions in monuments, and also development of monuments together with their historical and architectural and historical and town-planning circle.

Article 3. Principles of regulation

Subjects of this law perform the activities with respect for the following basic principles:

efficiency - proper use of financial resources in processes of allocation and distribution in all territory of the Republic of Moldova;

justice - non-discriminatory application of provisions of regulations and selection criteria of receivers of financing from means of National fund of culture so that any receiver had equal opportunities for receipt of financing;

free competition - providing conditions for any receiver developing and realizing cultural and publishing projects, and also projects on protection and development of monuments in the fields of activity established by this law he had the right to request financing of the cultural, publishing projects and projects on protection and development of monuments in the procedure established by the law;

planning - system process within which the state creates own vision of the future and depending on the available resources develops the corresponding steps for achievement of this future;

transparency - clarity of information on processes of allocation, distribution and use of means for realization and financing of cultural, publishing projects, projects on protection and development of monuments, as well as provision of this information to all concerned parties;

irreversibility - exception of possibility of the direction of non-paid financial resources on action which realization was already begun or complete at the time of the conclusion of the agreement on financing;

ezhegodnost - annual carrying out tenders on selection of cultural, publishing projects, projects on protection and development of monuments, as well as use of the assignments approved by the government budget.

Article 4. Basic concepts

For the purposes of this law the following concepts mean:

the receiver - the organization of culture, the creative figure, physical person or legal entity, the owner, the administrator or the managing director of the monument or the real estate unit located in the territory of memorial object or in the territory of memorial ensemble who can receive according to the law financing on cultural, publishing projects and projects on protection and development of monuments;

financing - financial support at the expense of funds of National fund of culture for cultural, publishing projects and projects on protection and development of monuments;

the cultural project - complex of the actions characteristic of the sphere of culture connected with achievement of particular cultural purpose and performed during the certain period of time.

Chapter II. Means and appointment of national fund of culture

Article 5. National fund of culture

(1) the National fund of culture (further - Fund) represents set of the financial resources intended for financing of cultural, publishing projects and projects on protection and development of monuments.

(2) the Fund is component of the government budget and affirms the annual law on the government budget according to provisions of the Law on public finance and budget and tax responsibility No. 181/2014.

(3) Financial resources of Fund are created of the following sources:

a) the assignments which are annually approved by the law on the government budget;

b) the gained income, including the payments made as compensation of the damage caused to cultural values and objects;

c) other legal sources.

(4) the Fund is controlled organization subordinated to the Ministry of Culture on realization.

(5) Fund is controlled through the single treasurer account of the Ministry of Finance.

(6) Annual distribution of the funds allocated to Fund is made by organization on realization.

Article 6. Appointment Fonda

(1) Fund is used for financing of cultural, publishing projects and projects on protection and development of monuments on the following activities:

a) programs of support of projects of non-profit organizations in the field of culture;

b) programs of support of publishing activities and literary translations;

c) programs of support of magazines for culture;
