1. This Procedure determines cases in case of which the navigation seal can be removed along the line (transportations) on the territories of state members of the Eurasian Economic Union (further - state members) without the termination of observation of subject to tracking, transaction by removal of navigation seals and their subsequent imposing, actions of national operators, authorized operators (bodies) and monitoring bodies involved in case of such removal (imposing) and procedure for their making.

2. The concepts used in this Procedure are applied in the values determined by the Agreement on application in the Eurasian Economic Union of navigation seals for tracking of transportations of April 19, 2022.

3. The navigation seal can be removed along the line (transportations) on the territories of state members without the termination of observation of subject to tracking in the following cases:

a) in case of customs procedure of customs transit and customs procedure of export:

carrying out the state control (supervision) in the cases determined proceeding from the principle of optionality of forms and control measures including with use of risk management system;

implementation of unloading, overload (transfer) and other cargo operations with subject to tracking;

the cases carried to emergency situations according to the Decision of Board of the Eurasian economic commission of August 22, 2023 No. 131 "About determination of the cases carried to emergency situations which arose along the line (transportations) on the territories of state members of the Eurasian Economic Union of subjects to tracking";

b) within mutual trade between state members:

carrying out the state control (supervision) proceeding from the principle of optionality of forms and control measures, including with use of risk management system, concerning the subjects to tracking imported on the territory of state member which monitoring body carries out such control (supervision) in delivery location (unloading) of goods, in case of impossibility of its carrying out in the place of their delivery (unloading) - along the line (transportations) on the territories of state members if:

there are no transport (transportation) documents and invoices (invoices), including the electronic, and also allowing documents accompanying subject to tracking or there are signs of invalid documents (forgery documents, documents relating to other goods and (or) vehicles or the documents which do not have legal force);

the weight characteristics specified in transport (transportation) documents differ from results of weighing of the vehicle following the results of weight and dimensional control more than for 10 percent;

there are signs of movement of the goods which are not declared in the transport (transportation) documents revealed on analysis results of information obtained with use of inspection and customs complex (if the inspection and customs complex was applied in case of monitoring procedure);

implementation of unloading, overload (transfer) and other cargo operations with subject to tracking;

the cases carried to emergency situations according to the Decision of Board of the Eurasian economic commission of August 22, 2023 No. 131;

availability of the orienting information from competent authorities of state members on fight against terrorism, separatism and extremism, organized crime, drug trafficking, and also weapon, ammunition and explosives;

implementation of the check which is not contradicting the Agreement on the Eurasian Economic Union of May 29, 2014 at check points between state members, and in case of lack of such Items - in places of crossing of frontier of state member, proceeding from the principle of optionality of forms and control measures.

4. In case of adoption by monitoring body of the decision on carrying out the state control (supervision) and removal of navigation seal without the termination of observation of subject to tracking such removal and the subsequent imposing of navigation seal are made in perhaps short terms from the moment of adoption of this decision.
