Chapter I. General provisions

Article 1. Tasks of this Federal Law

This Federal Law determines the legal basis of safety of traffic in the territory of the Russian Federation.

Tasks of this Federal Law are: protection of life, health and property of citizens, protection of their rights and legitimate interests, and also protection of interests of society and state by the prevention of the road accidents, decrease in weight of their effects.

Article 2. Main terms

For the purposes of this Federal Law the following main terms are applied:

traffic - set of the public relations arising in the course of movement of people and loads by means of vehicles or without those within roads;

traffic safety - the condition of this process reflecting degree of security of his participants from the road accidents and their effects;

the road accident - the event which arose in the course of movement on the road of the vehicle and with its participation with which people died or are wounded vehicles, constructions, loads are damaged or other material damage is caused;

traffic safety - the activities directed to the prevention of origins of the road accidents, decrease in weight of their effects;

the participant of traffic - person which is directly involved in the course of traffic as the transport driver, the pedestrian, the passenger of the vehicle;

paragraph of the seventh ceased to be valid;

the road - the strip of the earth equipped or adapted and used for movement of vehicles or surface of artificial construction. The road includes one or several carriageways, and also tram ways, sidewalks, roadsides and dividing strips in case of their availability;

the vehicle - the device intended for transportation across roads of people, loads or the equipment installed on it;

the transport driver - person managing the vehicle (including training to vehicle control);

the parking (parking space) - specially designated and if necessary the equipped and equipped place which is including part of the highway and (or) adjoining the carriageway and (or) the sidewalk, roadside, platform or the bridge or being part of subtrestle or subbridge spaces, the areas and other objects of street road net, buildings, structures or constructions and intended for the organized parking of vehicles on paid basis or without collection of payment according to the decision of the owner or other owner of the highway, the owner of the parcel of land or the owner of the corresponding part of the building, structure or construction;

the tachograph - the technical tool of control providing the continuous, not adjusted registration of information on speed and traffic route of the vehicle about time of vehicle control and rest of the transport driver, about work-rest schedule of the transport driver, management of which belongs to its labor duties.

The terms specified in part one of this Article can be specified according to the program of experimental legal regime in the field of digital innovations approved according to the Federal Law of July 31, 2020 No. 258-FZ "About experimental legal regimes in the field of digital innovations in the Russian Federation".

Article 3. Basic principles of safety of traffic

The basic principles of safety of traffic are:

priority of life and health of the citizens participating in traffic over economic results of economic activity;

priority of responsibility of the state for safety of traffic over responsibility of the citizens participating in traffic;

respect for interests of citizens, societies and the states in case of traffic safety;

program and target approach to activities for traffic safety.

Article 4. The legal basis of traffic safety in the Russian Federation

The legislation of the Russian Federation on traffic safety consists of this Federal Law and other Federal Laws adopted according to them other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation, municipal legal acts.

According to the Federal Law of July 31, 2020 No. 258-FZ "About experimental legal regimes in the field of digital innovations in the Russian Federation" in the field of safety of traffic can be established the special regulation different from the regulation provided by provisions of this Federal Law. Such special regulation is established by the program of experimental legal regime in the field of digital innovations approved according to the specified Federal Law. The provisions of this program establishing conditions of experimental legal regime in the field of digital innovations can change or exclude action of provisions of this Federal Law if it is directly provided by this Federal Law.

Chapter II. State policy in the field of traffic safety

Article 5. Main directions of safety of traffic

Safety of traffic is performed by means of:

establishments of powers and responsibility of government of the Russian Federation, federal executive bodies, executive bodies of subjects of the Russian Federation and local government bodies;

coordination of activities of federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies, public associations, legal entities and physical persons for the purpose of the prevention of the road accidents and decrease in weight of their effects;

regulations of activities on road, urban land electric transport and in road economy;

developments and approvals in accordance with the established procedure legislative, other regulatory legal acts concerning safety of technical regulations, rules, the documents on standardization accepted in accordance with the legislation of the Russian Federation about standardization, technical regulations and other regulating documents;

implementation of activities for the organization of traffic:

material and financial provision of actions for traffic safety;

organizations of training of transport drivers and training of citizens in rules and safety requirements of movement;

carrying out complex of actions for medical support of traffic safety;

implementation of obligatory certification or declaring of compliance of vehicles, and also components of designs, pieces of the additional equipment, spare parts and accessories of vehicles;

licensing of the separate types of activity performed on road transport, in accordance with the legislation of the Russian Federation;

carrying out socially oriented policy in insurance field on transport;

control (supervision) in the field of traffic safety.

Article 6. Powers of the Russian Federation, subjects of the Russian Federation, local government bodies and owners of private highways in the field of traffic safety

1. Are under authority of the Russian Federation:

forming and carrying out in the territory of the Russian Federation single state policy in the field of traffic safety;

establishment of the legal basis of safety of traffic;

establishment of technical regulations, rules, the documents on standardization accepted in accordance with the legislation of the Russian Federation about standardization, technical regulations and other regulating documents concerning traffic safety;

control of compliance of the laws and other regulatory legal acts of subjects of the Russian Federation in the field of safety of traffic of the Constitution of the Russian Federation and to the Federal Laws;

creation of the federal executive bodies providing realization of state policy in the field of traffic safety;

development and approval of federal programs of increase in traffic safety and their financial provision;

paragraph of ceased to be valid;

the organization and control (supervision) in the field of traffic safety;

coordination of activities of executive bodies of subjects of the Russian Federation in the field of traffic safety:

the conclusion of international treaties of the Russian Federation in the field of traffic safety.

2. Powers of federal executive bodies in the field of safety of traffic are payment commitments of the Russian Federation.
