About measures for project implementation "Purchase of electrobuss for public transport of the city of Samarkand and creation of directly related infrastructure" with participation of the European Bank for Reconstruction and Development

For the purpose of complex development of public transport of the city of Samarkand, rendering safe and high-quality transport services to passengers, and also phased transition to operation of effective and eco-friendly modes of transport:

1. Take into consideration that:

a) between the Republic of Uzbekistan and the European Bank for Reconstruction and Development (further - the EBRD) the Loan agreement on project implementation "Purchase of electrobuss for public transport of the city of Samarkand and creation of directly related infrastructure" (further - the project) in the amount of 49 million US dollars for a period of 18 years, including three-year grace period on May 17, 2023 is signed;

b) the total cost of the project constitutes 61, 99 million US dollars, including:

borrowed funds of the EBRD - 49 million US dollars;

contribution of the Republic of Uzbekistan to project implementation - 12, 99 million US dollars, including in the form of covering of the value added tax and provision of customs privileges, and also financing of expenses of project implementation team at the expense of Fund of development of transport and logistics under the Ministry of transport;

c) within the project are provided also reconstruction of the bus fleet in the city of Samarkand intended for storage, maintenance and repair of the railway vehicles including training center on preparation and advanced training of drivers and also construction of facilities of external electric utility service;

d) between the State company "Samarqandyo" lovchitrans" Managements of transport of the Samarkand region (further - GP "Samarqandyo " lovchitrans") and the company declared as the winner following the results of the international tender "Yutong Bus Co., Ltd" People's Republic of China is signed the contract for total amount 29, by 7 million US dollars on acquisition of 100 electrobuss and 50 chargers;

within this agreement in May, 2023 delivery of 6 electrobuss and 3 chargers is performed, these electrobuss are delivered on routes of urban public transport;

e) the period of project implementation constitutes 3 years (2023 - 2025).

2. Determine that:

the project is financed by the borrowed funds allocated by the EBRD;

the actuators responsible for timely and high-quality project implementation, and also target and effective use of loan of the EBRD, the Ministry of transport and khokimiyat of the Samarkand region are;

GP "Samarqandyo " lovchitrans" is beneficiary of the project;

repayment of the main loan of the EBRD, the percent added on it, initial one-time and obligatory payments within the project are made at the expense of means of the local budget of the Samarkand region;

the electrobuss and chargers which are purchased within the project are transferred to finance lease to private sector (carriers) by selection of the best offers;

the purchased electrobuss, according to the procedure of exception, are assigned directly to the regular city bus routes which are selected within the project on basis gross - contact for a period of 7 years. At the same time the cost of routes is created in accordance with the established procedure;

storage and servicing of the electrobuss and chargers transferred to finance lease is performed in the bus fleet reconstructed within the project according to the procedure established between GP "Samarqandyo " lovchitrans" and carriers on the basis of the agreement;

information on the mastered means and the achieved project deliverables is regularly published on official websites of the Ministry of transport and khokimiyat of the Samarkand region.

3. Form the Interdepartmental working group on transfer to finance lease of electrobuss and chargers in structure according to appendix No. 1 * and to determine it the main objectives:

determination of procedures of carrying out tender for transfer to finance lease and the minimum requirements imposed to participants of tender;

development and approval of conditions of transfer to finance lease;

carrying out tender, assessment of proposals of participants of tender and determination of winners;

development and approval of the standard agreement on transfer to finance lease;

determination of operating conditions of bus fleet of GP "Samarqandyo " lovchitrans" by carriers (winners of tender).

4. Determine that:

the electrobuss and chargers transferred to finance lease are exposed on the competitive biddings on lots by the regular city bus routes which are selected within the project;

the agreement of finance lease is signed for a period of 10 years from which funds are allocated in Special fund of financing of public transport of the Samarkand region;

in case of complete execution by the lessee of the obligations provided by the agreement of finance lease, electrobuss and chargers carry over the lessee;

the bus fleet reconstructed within the project services carriers (winners of tender) under lease and is not subject to realization or alienation to the third parties.

5. Approve:

The main indicators of the feasibility statement on the "Purchase of Electrobuss for Public Transport of the City of Samarkand and Creation of Directly Related Infrastructure" project with participation of the European Bank for Reconstruction and Development according to appendix No. 2 *;

The forecast repayment schedule of the main loan of the EBRD attracted within the "Purchase of Electrobuss for Public Transport of the City of Samarkand and Creation of Directly Related Infrastructure" project, payment of the percent added on it and also initial one-time and obligatory payments according to appendix No. 3 *;

The delivery schedule of electrobuss and chargers for public transport of the city of Samarkand according to appendix No. 4*.

6. (A. Tashkulov) to provide to the Ministry of Justice in accordance with the established procedure issue of the legal conclusion under the loan agreement between the Republic of Uzbekistan and the EBRD.

7. (E. Turdimov) to provide to khokimiyat of the Samarkand region transfer of real estate objects of the physical persons and legal entities located in the territories in which construction of facilities within the project, and compensation of the damage caused to the owner according to the procedure, established by the legislation is planned.

8. (I. Makhkamov) in a month in coordination with the EBRD to provide to the ministry of transport creation of the Project implementation team under the Ministry of transport.

9. To the chairman of the board of Ministers of the Republic of Karakalpakstan and hokima of areas together with the Ministry of transport, the Ministry of investments, industry and trade in two-month time to develop projects on purchase of electrobuss for public transport of the city of Nukus and the regional centers.

10. To the republican headquarters on control and coordination of implementation of state programs (S. Samadov) to establish constant control behind target allocation and use of means within the project and each half a year to enter the relevant information in Administration of the President of the Republic of Uzbekistan.
