Chapter I. General provisions

Article 1. Emergency state

1. Emergency state means the particular legal regime of activities of public authorities, local government bodies, organizations entered according to the Constitution of the Russian Federation and this Federal constitutional Law in all territory of the Russian Federation or in its certain areas irrespective of legal forms and patterns of ownership, their officials, public associations allowing the separate restrictions of the rights and freedoms of citizens of the Russian Federation established by this Federal constitutional Law, foreign citizens, stateless persons, the rights of the organizations and public associations and also assignment on them subsidiary duties.

2. Introduction of emergency state is the temporary measure applied only for safety of citizens and protection of the constitutional system of the Russian Federation.

Article 2. Purposes of introduction of emergency state

The purposes of introduction of emergency state are elimination of the circumstances which formed the basis for its introduction, ensuring protection of rights and freedoms of man and citizen, protection of the constitutional system of the Russian Federation.

Chapter II. Circumstances and procedure for introduction of emergency state

Article 3. Circumstances of introduction of emergency state

State of emergency is imposed only in the presence of circumstances which represent direct threat of life and safety of citizens or to the constitutional system of the Russian Federation and which elimination is impossible without application of emergency measures. Treat such circumstances:

a) attempts of violent change of the constitutional system of the Russian Federation, capture or assignment of the power, armed rebellion, mass riots, acts of terrorism, blocking or capture of especially important objects or certain areas, preparation and the activities of illegal armed groups, the international, interfaith and regional conflicts which are followed by violent acts, creating direct threat of life and safety of citizens, normal activities of public authorities and local government bodies;

b) to entail the emergency situations of natural and technogenic nature, emergency ecological situations, including the epidemics and epizooty which resulted from accidents, natural hazards, catastrophic crashes, natural and other disasters, entailed (able) the human victims, drawing damage to health of people and the surrounding environment, considerable material losses and violation of conditions of life activity of the population and the requiring carrying out large-scale rescue and other urgent works.

Article 4. Introduction of emergency state

1. Emergency state in all territory of the Russian Federation or in its certain areas is entered by the presidential decree of the Russian Federation with the immediate message on it to the Federation Council of Federal Assembly of the Russian Federation and the State Duma of Federal Assembly of the Russian Federation.

2. The presidential decree of the Russian Federation about introduction of emergency state is without delay transferred to approval of the Federation Council of Federal Assembly of the Russian Federation.

Article 5. Contents of the presidential decree of the Russian Federation about introduction of emergency state

In the presidential decree of the Russian Federation about introduction of emergency state shall be determined:

a) the circumstances which formed the basis for introduction of emergency state;

b) reasons for need of introduction of emergency state;

c) borders of the territory on which state of emergency is imposed;

d) forces and means providing emergency rule;
