4. To impose control of execution of this joint order on the vice-Ministers of Justice supervising the corresponding direction, digital development of innovations and the aerospace industry, finance of the Republic of Kazakhstan.

5. This joint order becomes effective since July 1, 2024 and is subject to official publication.

Procedure for realization of pilot project on the termination of activities of the legal entity for the liquidation basis in the automated mode

Chapter 1. General provisions

1. This procedure determines process of the termination of activities of the legal entity (the commercial organizations) (further - Uslugopoluchatel) by the liquidation basis in the automated mode (further - the Procedure) and is developed according to article 22 of the Law of the Republic of Kazakhstan "About the state services".

Chapter 2. Procedure for realization of pilot project

2. Uslugopoluchatel publishes information on liquidation of the legal entity according to Article 50 of the Civil code of the Republic of Kazakhstan.

3. Uslugopoluchatel by means of the web portal of "the electronic government" of www.egov.kz (further - the Portal) submits the application for the termination of activities of the legal entity according to appendix to this Procedure.

The interim liquidation balance sheet in PDF format is attached to the statement.

4. Payment for state registration of the termination of activities of the legal entity to Non-commercial joint-stock company "The Government for Citizens state corporation (further - the Service provider) is performed through payment gateway of "the electronic government".

5. In case of filing of application, in the automatic mode through the Portal from the state database "Legal entities" (further - GBD YUL) request data on availability of the registered branches (representations).

In case of their establishment to Uslugopoluchatel the notification on their availability goes.

6. The statement with the interim liquidation balance sheet attached in PDF format arrives in the integrated system of tax administration (further - ISNA) for conducting the checks provided by the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget (Tax code)".

7. Following the results of checks, the positive conclusion goes from ISNA to GBD YUL, according to requirements of Item 3 of Article 50 of the Civil code.

8. After receipt in GBD YUL of positive result, within 1 (one) working day in the automatic mode the data provided by items 4 and 5 presents About are requested and the order on state registration of the termination of activities of the legal entity, or on refusal in registration which goes to Uslugopoluchatel "personal account" is created.

9. In case of registration of the termination of activities of the legal entity of GBD YUL sends the notification to ISNA for removal from accounting of legal entities with the status "Liquidation".

Chapter 3. Procedure for appeal of result

10. In case of appeal of decisions, actions (failure to act) of Uslugodatel and (or) his officials the claim is submitted addressed to the head Uslugodatel, in authorized bodies in the field of rendering the state service and in grade and control of quality of rendering the state services according to the legislation of the Republic of Kazakhstan.

11. Uslugopoluchatel's claim which arrived to the Service provider and in authorized bodies in the field of rendering the state service is subject to consideration within 5 (five) working days from the date of its registration.

Uslugopoluchatel's claim which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 (fifteen) working days from the date of its registration.

12. In case of disagreement with the decision made by results of appeal of rendering the state service, Uslugopoluchatel takes a legal action in the procedure established by the legislation of the Republic of Kazakhstan.
