About safety of hydraulic engineering constructions
This Federal Law governs the relations arising when implementing activities for safety during the designing, construction, capital repairs, operation, reconstruction, preservation and liquidation of hydraulic engineering constructions, establishes obligations of public authorities, owners of hydraulic engineering constructions and the operating organizations for safety of hydraulic engineering constructions.
This Federal Law extends to hydraulic engineering constructions which are specified in article 3 of this Federal Law and which damages can lead to emergence of emergency situation.
The legislation on safety of hydraulic engineering constructions consists of this Federal Law and the laws adopted according to it and other regulatory legal acts of the Russian Federation.
If the international treaty of the Russian Federation establishes other rules, than those which are provided by this Federal Law are applied rules of the international treaty.
The decisions of interstate bodies made based on provisions of international treaties of the Russian Federation in their interpretation contradicting the Constitution of the Russian Federation are not subject to execution in the Russian Federation. Such contradiction can be established according to the procedure, determined by the Federal constitutional Law.
In this Federal Law the following basic concepts are used:
hydraulic engineering constructions - dikes, buildings of hydroelectric power stations, water waste, vodospuskny and water final constructions, tunnels, channels, pumping points, navigable locks, ship elevators; the constructions intended for protection against floods, destructions of coast and bottom of water storage basins, the rivers; constructions (dam) protecting storages of liquid waste of industrial and agricultural organizations; devices from washouts on channels, and also other constructions, buildings, devices and other objects, held for use water resources and prevention of negative impact of waters and liquid waste, except for objects of the centralized systems of hot water supply, cold water supply and (or) water disposal provided by the Federal Law of December 7, 2011 N 416-FZ "About water supply and water disposal";
the operating organization - state either municipal unitary enterprise or the organization of any other form of business on which balance there is hydraulic engineering construction;
the owner of the hydraulic engineering construction - the Russian Federation, the subject of the Russian Federation, municipality, physical person or the legal entity irrespective of its form of business having rights of possession, uses and orders of the hydraulic engineering construction;
emergency situation - the situation in certain territory which developed as a result of accident of the hydraulic engineering construction which can entail or entailed the human victims, damage to health of people or environmental damage, considerable material losses and violation of conditions of life activity of people;
safety of hydraulic engineering constructions - the property of hydraulic engineering constructions allowing to provide protection of life, health and legitimate interests of people, the environment and economic objects;
the declaration of safety of the hydraulic engineering construction - the document in which safety of the hydraulic engineering construction is proved and measures for safety of the hydraulic engineering construction taking into account its class are determined;
