About measures for increase in efficiency of activities of public authorities on places

In recent years in the country the large-scale reforms according to the solution of topical issues of social and economic development of regions, social protection of the population aimed at democracy realization fully by expansion of powers local Kengasha of People's Deputies are undertaken.

For the purpose of expansion of control functions of People's Deputies by Kengasha behind activities of executive bodies on places more than ten additional powers are conferred to them. In particular, accountability of heads of bodies of prosecutor's office, justice, internal affairs, health cares, ecology, financial and tax authorities is established.

1. Approve developed by the Senate of the Oliy Majlis of the Republic of Uzbekistan, the Ministry of Justice and local Kengashami of People's Deputies (further - local Kengasha):

The list of the powers recommended for transfer local Kengasham of People's Deputies for the purpose of increase in role of representative bodies of the government on places in the solution of important issues of life of the state and society according to appendix No. 1 *;

Powers and functions local Kengasha of People's Deputies, recommended for systematization, according to appendix No. 2 *;

"Road map" on enhancement of acts of the legislation on the organization of activities of public authorities on places by the principle "The strong Kengash accountable and initiative hoky" according to appendix No. 3*.

2. Determine that:

tasks and functions are assigned on local Kengasha only according to legal acts;

intervention of state governing bodies in activities local Kengasha is not allowed;

in case of project development of regulatory legal acts practice of accurate differentiation of functions between representative bodies of the government on places and executive bodies on places takes root;

executive bodies on places bear responsibility for accomplishment of the tasks assigned by regulatory legal acts to public authorities on places and which are unusual for powers local Kengasha established by the legislation.

3. Recommend to the Senate of the Oliy Majlis of the Republic of Uzbekistan to develop together with the Cabinet of Ministers till October 1, 2024 the Concept of development of activities of representative bodies of the government on places in Uzbekistan till 2030, having provided in it the following main directions:

enhancement of control activities local Kengasha, their bodies and deputies, forming of the effective control system;

determination of the mechanism of introduction local Kengashami of offers in the Senate of the Oliy Majlis on the important and topical issues concerning interests of the territories;

enhancement of activities local Kengasha in the sphere of rule-making;

ensuring broad participation of the public in development of decisions local Kengasha;

further strengthening of basic guarantees of the status and activities of deputies local Kengasha;

establishing interaction and international cooperation in activities local Kengasha;

complete digitalization of activities local Kengasha, determination of measures of counteraction of bureaucracy.

4. To the Ministry of Foreign Affairs to involve leading experts of the foreign states in development of the Concept of development of activities of representative bodies of the government on places in Uzbekistan till 2030 and to organize office and educational trips for studying of the advanced international practice.

5. To the ministries and departments to make in the Ministry of Justice offers on specialization of tasks and functions between representative bodies of the government on places and executive bodies on the places assigned to public authorities on places by acts of the legislation according to appendix No. 3 * to this Decree in a month.

To the Ministry of Justice based on offers of the ministries and departments in three-months time to develop and introduce drafts of the relevant acts of the legislation to the Cabinet of Ministers.

At the same time to focus special attention on critical consideration of project data from the point of view of availability of the rules and regulations implementing excessive administrative and other restrictions for physical persons and legal entities.

6. Recommend to chambers of Oliy Majlis of the Republic of Uzbekistan to systematize in two-month time the resolutions on activities local Kengasha with carrying out their complete inventory.

7. Recommend to the Senate of the Oliy Majlis of the Republic of Uzbekistan:

till July 1, 2024 development and implementation of maintaining register of powers, tasks and functions local Kengasha;

develop offers on implementation of single practice in project development of decisions local Kengasha and their acceptance;

to systematically organize the training courses directed to increase in knowledge and qualification of deputies and employees of the secretariats local Kengasha together with the Ministry of Justice.

8. To agency on management of the state assets together with the Ministry of Construction and Housing and Communal Services and Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent till April 1, 2024:

carry out inventory count of current status of buildings local Kengasha;

develop together with the Senate of the Oliy Majlis of the Republic of Uzbekistan the minimum requirements to buildings local Kengasha and to their material equipment;

develop and submit for approval in the Cabinet of Ministers "road map" on providing with buildings (studies) and their equipment taking into account the established minimum requirements for regional and Tashkent city Kengasha of People's Deputies till October 1, 2024, for district and city Kengasha of People's Deputies - till December 1, 2025.

9. Make changes to some acts of the President of the Republic of Uzbekistan according to appendix No. 4*.

10. To the Ministry of Justice together with the interested ministries and departments in two-month time to make offers in the Cabinet of Ministers:
