About approval of the Standard charter of consolidation of owners of property

According to subitem 10-20) of article 10-2 of the Law of the Republic of Kazakhstan "About the housing relations", PRIKAZYVAYU:

1. Approve the enclosed Standard charter of consolidation of owners of property.

2. To provide to committee on cases of construction and housing and communal services of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Standard charter of consolidation of owners of property

Chapter 1. General provisions

1. This Standard charter of consolidation of owners of property, at the address: ____________ (legal address) (further - the Charter), it is developed according to the Civil code of the Republic of Kazakhstan, the Laws of the Republic of Kazakhstan "About the housing relations", "About non-profit organizations" and approved by the decision of meeting of owners of apartments, non-residential premises from _____________ years (the protocol No. __).

2. Consolidation of owners of property (further - consolidation) is legal entity, in the form of the non-profit organization formed by owners of apartments, non-residential premises of one apartment apartment house the exercising control of object of condominium financing it content and ensuring its safety.

3. For the purpose of management of object of condominium, financing of its content and ensuring safety of common property of object of condominium with owners of apartments, non-residential premises of one apartment apartment house Consolidation is created.

3-1. In the apartment apartment houses located on the single base or having single all-house engineering systems or the single indivisible parcel of land under the apartment apartment house and (or) house adjoining the parcel of land owners of apartments, non-residential premises create one consolidation of owners of property in case of the consent of most of owners of apartments, non-residential premises of each apartment apartment house.

Chapter 2. Subject and purposes of activities of Consolidation

7. Object of activity of Consolidation:

1) management of object of condominium, financing of its content;

2) ensuring safety of common property of object of condominium with owners of apartments, non-residential premises;

3) represents the interests of the members in all courts, state bodies and the organizations;

4) entering of offers into state bodies on management, content and to ensuring safe operation of the apartment apartment house;

5) check of quantity and quality of the utilities received the apartment apartment house on all-house metering devices on compliance to the payment for them shown to owners of apartments, non-residential premises;

6) determination of terms of planned (current) and capital repairs in the apartment apartment house and the organization of control of carrying out repair work;

7) performs other functions established by the Law of the Republic of Kazakhstan "About the housing relations", the legislation of the Republic of Kazakhstan and this Charter.

8. The purpose of activities of Consolidation is management of object of condominium, financing of its content and ensuring safety of common property of object of condominium with owners of apartments, non-residential premises of one apartment apartment house.

Chapter 3. Rights and obligations of Consolidation

9. Consolidation in the right:

1) to distribute information on the activities;

2) to open accounts in banks in the procedure established by the legislation;

3) to have seal, stamps and forms with full name of the organization in the state and Russian languages, and also emblem (symbolics) registered in accordance with the established procedure;

To have 4) in property or in operational management the isolated property, and also separate balance or the estimate;

5) to acquire and perform the property and personal non-property rights;

6) to use funds for implementation of the purposes provided in the charter;

7) to be claimant and the defendant in court;

8) to provide to the participants opportunity to study the documents and decisions affecting their rights and interests;

9) to perform other rights which are not contradicting the legislation of the Republic of Kazakhstan.

10. Consolidation shall:

1) to observe the legislation of the Republic of Kazakhstan;

2) to pay taxes and other obligatory payments to the budget in accordance with the established procedure;

3) to answer for the obligations all property belonging to them (except for organizations);

4) to inform the participants on receipt and expenditure of money, according to form of the monthly and annual reports on management of object of condominium and content of common property of object of condominium approved by authorized body;

5) to bear responsibility according to legal acts of the Republic of Kazakhstan.

Chapter 4. Structure of Consolidation

11. Governing bodies of Consolidation are:

1) the Supreme body - meeting of participants of Consolidation (further - the Meeting);

2) Executive body - the chairman of Consolidation;

3) Collegiate organ of management - council of the apartment apartment house (further - council of the house);
