About approval of Rules of registration and accounting of the accidents connected with labor activity

According to subitem 4-3) of Article 17 of the Labor code of the Republic of Kazakhstan PRIKAZYVAYU:

1. Approve the enclosed Rules of registration and accounting of the accidents connected with labor activity.

2. To provide to committee of work and social protection in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet - resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of registration and accounting of the accidents connected with labor activity

Chapter 1. General provisions

1. These rules of registration and accounting of the accidents connected with labor activity (further - Rules) are developed according to subitem 4-3) of Article 17 of the Labor code of the Republic of Kazakhstan (dalee-Kodeks) and determine order of registration and accounting of the accidents connected with labor activity.

2. In these rules the following basic concepts are used:

1) territorial subdivisions of authorized state body on work (territorial subdivisions) – the structural divisions of authorized state body on work performing within the corresponding administrative and territorial unit of power in the field of regulation of employment relationships according to the legislation of the Republic of Kazakhstan;

2) the accident connected with labor activity - impact on the worker, the worker of the sending party of harmful and (or) dangerous production factor in case of accomplishment of labor (office) obligations or tasks of the employer or host party from whom the industrial injury, sudden deterioration in health or poisoning of the worker, worker of the sending party which led them to temporary or permanent disability or death resulted by it;

3) information system on labor protection and safety - the information system intended for automation of accounting of results of checks of the state inspectors of work, investigations of the accidents connected with labor activity;

4) employer - physical person or legal entity with which the worker consists in employment relationships.

Chapter 2. Order of registration and accounting of the accidents connected with labor activity

3. The employer within a day reports about the happened accident connected with labor activity in territorial subdivision in the place of state registration of the employer.

4. Each accident connected with labor activity is subject to investigation.

5. Upon termination of investigation of each accident connected with labor activity according to investigation materials the employer no later than three working days sends the act of accident to territorial subdivision on paper and electronic carriers.

6. Registration and accounting of the accidents connected with labor activity is performed by territorial subdivision in information system on labor protection and safety in the place of state registration of the employer.

7. Each act of accident connected with labor activity is entered by territorial subdivision into information system on labor protection and safety in time no later than 2 working days from the date of receipt from the employer of the act of accident which contains the following data:

1) full name of the employer, type of activity;

2) legal address of the employer;

3) time and date of accident;

4) place of accident;

5) type of the incident which led to accident;

6) surname, name, middle name (in case of its availability) the victim;

7) floor (men's, women's);

8) age of the victim;

9) profession, victim's position;

10) length of service of the victim by this profession in case of which accomplishment there was accident (occupational disease);

11) dates of instructing and examination;

12) dates of passing of medical examinations;

13) the number of complete hours from the beginning of work;

14) circumstances of accident;

15) basic reasons of accident;

16) eyewitnesses of accident;

17) physical condition of the victim at the time of accident;

18) severity of injury of the victim;

19) diagnosis of the victim;

20) actions for elimination of accident causes and performing prevention directed to prevention of accidents;

21) fault degree (employer and worker).

8. The accidents connected with labor activity, stipulated in Item 2 articles 186 of the Code are subject to accounting.
