About approval of the model charter of credit union

According to Articles 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 8 of the Law of Ukraine of July 14, 2023 No. 3254-IX "About credit unions", for the purpose of determination of basic provisions of the constituent document of credit union based on which it can perform the activities the Board of the National Bank of Ukraine DECIDES:

1. Approve the enclosed model charter of credit union.

2. To department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform credit unions information on adoption of this resolution.

3. The resolution becomes effective since January 1, 2024.

Model charter of credit union

I. General provisions

1. The credit union (further - Credit union) is created according to the legislation of Ukraine and acts on the basis of the this model Charter (further - the Charter).

2. The name of Credit union is determined in the procedure established by the legislation of Ukraine and introduced in the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the Unified state register).

3. The abbreviated name of Credit union in case of availability is determined in the procedure established by the legislation of Ukraine and entered in the Unified state register.

4. The purpose of creation and activities of Credit union is the requirements satisfaction of his members in mutual lending, provision of the financial services and other services determined by the Law of Ukraine "About credit unions" (further - the Law), and also implementation of other activities determined by the Law at the expense of the integrated money contributions of credit union members and other sources determined by the Law.

5. The credit union is legal entity from the date of its state registration. The credit union has separate balance, accounts in banks, can have forms, logo, and also sign for goods and services and other details.

6. The credit union has the right to implementation of activities for provision of financial services after receipt of license for activities of Credit union.

7. Activities of Credit union are based on the basic principles determined in article 4 of the Law.

8. The credit union provides the following types of financial services-1:

1) based on the standard license:

provision of means and bank metals on credit;

attraction of financial resources and the bank metals which are subject to return;

2) based on the simplified license - provision of means and bank metals on credit.

9. Information on license types of Credit union, and also on their amount contains in the State register of financial institutions placed on the page of official Internet representative office of the National Bank of Ukraine (further - National Bank).

II. Membership in Credit union

10. Sign of membership in Credit union for physical persons and/or physical persons entrepreneurs is-1:

1) territorial sign (according to Item of 1 part two of article 14 of the Law). The name of administrative and territorial unit is specified in the decision of general meeting of Credit union.

Also legal entities specified in part one of article 14 of the Law if they conform to the requirements specified in part three of article 14 of the Law can be credit union members which is created on territorial sign;

2) joint place of employment (according to Item 2 parts two of article 14 of the Law). The name of the legal entity or surname, own name, middle name of the physical person entrepreneur who is the employer is specified in the decision of general meeting of Credit union;

3) belonging to one labor union (according to Item 3 parts two of article 14 of the Law). The name of labor union is specified in the decision of general meeting of Credit union;

4) belonging to one religious organization (according to item 4 of part two of article 14 of the Law). The name of the religious organization is specified in the decision of general meeting of Credit union;

5) the place of training and/or work in one educational institution (according to Item 5 parts two of article 14 of the Law). The name of institution is specified in the decision of general meeting of Credit union.

11. Credit union members have the right:

1) to participate in management of Credit union, to choose and be elected to governing bodies of Credit union;

2) to submit offers for consideration of governing bodies of Credit union;

3) to use financial and other services which are provided to credit union members according to the Charter;
