About safe handling of pesticides and agrochemicals

This Federal Law establishes the legal basis of ensuring safe handling of pesticides, including with their active ingredients, and also with agrochemicals for the purpose of health protection of people and the environment.

Chapter I. General provisions

Article 1. Basic concepts

In this Federal Law the following basic concepts are used:

pesticides - the substances or mix of substances including used as regulators of growth of plants, pheromones, defoliants, desiccants and fumigants and the medicines of chemical or biological origin intended for prevention of distribution and for destruction of weed plants and harmful organisms, including dangerous types of invasive (alien) plants;

agrochemicals - fertilizers (mineral, organic, organomineral, microbiological), the chemical ameliorants intended for food of plants and regulation of fertility of lands (soils). Peat, waste of livestock production and crop production, livestock production by-products, silt, rainfall of sewage used for production of organic and organomineral fertilizers, the mixed mineral fertilizers are not recognized agrochemicals;

the mixed mineral fertilizers - mechanical mix of two and more mineral fertilizers in strong aggregate state;

active ingredient of pesticide - biologically active part of pesticide which use in the form of different preparative forms leads to impact on this or that type of harmful organism, including dangerous type of invasive (alien) plant, or on growth and development of plants;

registration sample - the batch of the unregistered pesticide or agrochemical limited on amount according to the program of registration testing of pesticide or agrochemical, intended for carrying out registration testing;

laboratory researches of pesticides and agrochemicals - the researches of pesticides and agrochemicals conducted by the Russian test laboratories (centers), foreign test laboratories (centers) for the purpose of data acquisition about properties of pesticides and agrochemicals and (or) assessment of threat of damnification of life, to human health, harm to the environment including for the purpose of determination of residual amount of active ingredients of pesticides and agrochemicals in the environment and agricultural products;

residual amount of active ingredient of pesticide - quantitative index of content of active ingredient of pesticide and (or) products of its disintegration (metabolites) in the environment and agricultural products based on which safety of pesticide for human health, the environment is estimated;

the Russian test laboratory (center) - the Russian legal entity recognized to the corresponding principles of proper laboratory practice, the corresponding principles of proper laboratory practice of Organization for Economic Cooperation and Development according to the procedure, established by the Government of the Russian Federation;

foreign test laboratory (center) - the foreign legal entity having state registration according to the legislation of foreign state and recognized to the corresponding principles of proper laboratory practice, the corresponding principles of proper laboratory practice of Organization for Economic Cooperation and Development;

audit of foreign test laboratories (centers) - activities for conducting check of the foreign legal entities performing laboratory researches for the purpose of determination of residual amount of active ingredients of pesticides and agrochemicals in products of plant origin intended for import to the Russian Federation from the states which are not members of the Eurasian Economic Union for confirmation of competence of foreign test laboratories (centers), methods and results of the laboratory researches performed by them;

the program of registration testing of pesticide or agrochemical - the document determining amount, procedure and term of carrying out registration testing of pesticide or agrochemical, and also the amount of pesticide or agrochemical necessary for carrying out registration testing of pesticide or agrochemical, and in case of carrying out registration testing of pesticide also containing specifying on its appointment;

the applicant - the manufacturer or the developer who submitted the application for carrying out registration testing of pesticide or agrochemical, the request for conducting examination of regulations of use of pesticide or agrochemical, the request for conducting examination of results of registration testing of pesticide or agrochemical, the request for state registration of pesticide or agrochemical;

the manufacturer - the legal entity or physical person registered as the individual entrepreneur, including the foreign manufacturer enabling on its own behalf production and the realization of pesticides and (or) agrochemicals;

the address of pesticides and agrochemicals - production, application, realization, transportation, storage, destruction, packing, utilization, neutralization, burial, import to the Russian Federation and export from the Russian Federation;

Article 2. Legal regulation in the field of safe handling of pesticides and agrochemicals

Legal regulation in the field of safe handling of pesticides and agrochemicals is performed by this Federal Law, the laws and other regulatory legal acts of the Russian Federation, and also the laws and other regulatory legal acts of subjects of the Russian Federation.
