About safe handling of pesticides and agrochemicals

This Federal Law establishes the legal basis of ensuring safe handling of pesticides, including with their active ingredients, and also with agrochemicals for the purpose of health protection of people and the environment.

Chapter I. General provisions

Article 1. Basic concepts

In this Federal Law the following basic concepts are used:

pesticides - the substances or mix of substances including used as regulators of growth of plants, pheromones, defoliants, desiccants and fumigants and the medicines of chemical or biological origin intended for fight against harmful organisms;

agrochemicals - fertilizers (mineral, organic, organomineral, microbiological), the chemical ameliorants intended for power supply of plants and regulation of fertility of lands (soils). The peat, waste of livestock production and crop production, livestock production by-products, silt, sludges used for production organic and organomineral fertilizers, the mixed fertilizers are not recognized agrochemicals;

the mixed fertilizers - mechanical mix of two and more fertilizers in strong aggregate state;

active ingredient of pesticide - biologically active part of pesticide which use in the form of different preparative forms leads to impact on this or that type of harmful organism or on growth and development of plants;

the state registration of pesticides and agrochemicals - registration of pesticides and agrochemicals based on which the federal executive body performing functions on development of state policy and normative legal regulation in the field of agro-industrial complex, to rendering the state services in the field of agro-industrial complex grants permission for production, application, realization, transportation, storage, destruction, advertizing, import to the Russian Federation and export from the Russian Federation of pesticides and agrochemicals;

regulations of use of pesticides and agrochemicals - mandatory requirements to conditions and procedure for use of pesticides and agrochemicals;

developer - the legal entity or physical person, including the individual entrepreneur performing development of pesticides and (or) agrochemicals including research of their efficiency, and also studying of their influence on human health and the environment;

registration sample - the batch of the unregistered pesticide or agrochemical limited on amount according to the program of registration testing of pesticide or agrochemical, intended for carrying out registration testing;

not clinical laboratory clinical trials of pesticide - the pesticide researches conducted in laboratory and in the environment for the purpose of data acquisition about its properties and (or) estimates of threat of damnification of life, to human health, harm to the environment including for the purpose of determination of residual amount of active ingredient of pesticide in the environment and agricultural products;

the pesticide researches conducted in the environment - the pesticide researches conducted in the territory of the Russian Federation in the form of experiment or number of the experiments made outside test laboratory (center) including on part of the land surface in water objects, constructions (including greenhouses), it is frequent in combination with the activities performed in laboratory or pesticide researches conducted consistently that is at first researches are conducted in the environment, and then in laboratory and vice versa;

residual amount of active ingredient of pesticide - quantitative index of content of active ingredient of pesticide and (or) products of its disintegration (metabolites) in the environment and agricultural products based on which safety of pesticide for human health, the environment is estimated;

the Russian test laboratory (center) recognized the proper laboratory practice corresponding to the principles - the Russian legal entity recognized to the corresponding principles of proper laboratory practice according to the Federal Law of December 27, 2002 No. 184-FZ "About technical regulation";

foreign test laboratory (center) - the foreign legal entity having the state registration according to the legislation of foreign state and corresponding to the principles of proper laboratory practice of Organization for Economic Cooperation and Development;

the program of registration testing of pesticide or agrochemical - the document determining amount, procedure and term of carrying out registration testing of pesticide or agrochemical, and also the amount of pesticide or agrochemical necessary for carrying out registration testing of pesticide or agrochemical, and in case of carrying out registration testing of pesticide also containing specifying on its assignment;

the applicant - the manufacturer or the developer who submitted the application for carrying out registration testing of pesticide or agrochemical, the request for conducting examination of regulations of use of pesticide or agrochemical, the request for conducting examination of results of registration testing of pesticide or agrochemical, the request for the state registration of pesticide or agrochemical;

the manufacturer - the legal entity or physical person registered as the individual entrepreneur, including the foreign manufacturer enabling on its own behalf production and the realization of pesticides and (or) agrochemicals;

the certificate on the state registration of pesticide and (or) agrochemical - the document confirming the fact of the state registration of pesticide and (or) agrochemical and entering of these of pesticide and (or) agrochemical into the State catalog of the pesticides and agrochemicals allowed for use in the territory of the Russian Federation;

the address of pesticides and agrochemicals - production, application, realization, transportation, storage, destruction, packing, utilization, neutralization, burial, import to the Russian Federation and export from the Russian Federation;

the organizations which are carrying out registration testing (further - the organizations), - the legal entities performing registration testing of pesticides and agrochemicals in the territory of the Russian Federation;
