About the automated information system of civil unmanned aerial vehicles

Based on part two of subitem 1.7 of Item 1 of the Presidential decree of the Republic of Belarus of September 25, 2023 "About the state accounting and operation of civil unmanned aerial vehicles" the Council of Ministers of the Republic of Belarus DECIDES: No. 297

1. Approve Regulations on procedure for creation and maintaining the automated information system of the state accounting of civil unmanned aerial vehicles it (is applied).

2. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 22.10.2025 No. 575

2.2. The rules of rendering services of special communication approved by the resolution of Council of Ministers of the Republic of Belarus of June 10, 2014 No. 563, to add with Item 25-1 of the following content:

"25-1. Civil unmanned aerial vehicles and model aircrafts are sent to the address of legal entities and individual entrepreneurs in sending and packagings with observance of the requirements established by acts of the legislation.";

2.3. Item 13 of Rules of rendering the courier services approved by the resolution of Council of Ministers of the Republic of Belarus of August 7, 2014 No. 767, to add with the paragraph of the following content:

"civil unmanned aerial vehicles and model aircrafts.".

3. This resolution becomes effective since January 1, 2025.

Regulations on procedure for creation and maintaining the automated information system of the state accounting of civil unmanned aerial vehicles

1. This Provision determines procedure for creation and functioning of the automated information system of the state accounting of civil unmanned aerial vehicles, and also information exchange of state bodies and the state organizations (further, unless otherwise specified, - state bodies) by its use.

2. In this Provision terms and their determinations in the values established in the Law of the Republic of Belarus of November 10, 2008 No. 455-Z "About information, informatization and information security", the Air code of the Republic of Belarus, other acts of the legislation and also the following terms and their determinations are applied:

the automated information system of the state accounting of civil unmanned aerial vehicles (further - AIS BLA) - the complex of software intended for giving by legal entities, individual entrepreneurs of the statement for statement by legal entities, individual entrepreneurs of civil unmanned aerial vehicles (further - civil BLA) on the state accounting (removal from the state accounting) and obtaining from Department on aircraft of the Ministry of Transport and Communications (further - Department on aircraft) decisions on statement on the state accounting (removal from the state accounting), and also for provision of information containing in AIS BLA to state bodies, legal entities, individual entrepreneurs according to authorization in system;

authorization - provision process to the user or group of users of certain permissions, access rights and privileges in computer system;

maintaining AIS BLA - development, operation and servicing of AIS BLA;

the state accounting - the procedure as a result of which the civil BLA which is in legal ownership, use and (or) the order at legal entities, including individual entrepreneurs is considered;

applicants - legal entities, individual entrepreneurs, in legal ownership, use and (or) the order of which are civil BLA;

servicing of AIS BLA - complex of the transactions determined in the operating documentation by maintenance and maintenance of AIS BLA in proper condition;

users of AIS BLA - state bodies, the operator, legal entities, individual entrepreneurs;

development of AIS BLA - development and deployment of the following blocks: realization of the interface of interaction with the nation-wide automated information system; realization of the functions connected with obtaining, accumulating and storage of data on civil BLA and applicants; other development trends in the field of automation of processes of implementation of the state accounting of civil BLA;

operation of AIS BLA - the activities of the operator connected with introduction, accumulating, storage, updating, transfer and protection of data on civil BLA and applicants, forming and maintaining the AIS BLA databases, and also with ensuring proper functioning of AIS BLA.

3. AIS BLA provides:

obtaining from applicants of data on the state accounting, characteristics of the civil BLA necessary for entering into AIS BLA;

receipt by state bodies of information about applicants, the civil BLA which are on the state accounting, on a grant basis.

4. Financing of expenses on creation and maintaining AIS BLA is performed at the expense of the means of the republican budget provided to the Ministry of Transport and Communications and other sources which are not prohibited by the legislation.

The organization of creation and maintaining AIS BLA are performed by the operator. Operator of AIS BLA is the Department on aircraft.

5. Development of the technical and operational communication requirements to AIS BLA, and also the specification on creation of AIS BLA is performed by the Ministry of Transport and Communications in coordination with the interested state bodies within their competence.

6. The principles on the basis of which AIS BLA is created and functions are:

respect for constitutional rights of citizens in case of the automated information processing containing personal data;

providing technological capability of information exchange of the existing and newly created information systems of participants of information exchange;

ensuring technological independence of structure of AIS BLA and its functioning from the carried-out organizational and other changes of activities of participants of information exchange;

providing according to the legislation in case of storage and processing in AIS BLA, transfer (obtaining) with participation of users of AIS BLA of protection of public information, and also information which distribution and provision is limited, including ensuring confidentiality, integrity, availability and safety of information which distribution and provision is limited.

7. The AIS BLA databases are created on the basis of the information provided by applicants on characteristics of civil BLA and the applicants necessary for statement of civil BLA on the state accounting, and also about the considered civil BLA.
