About approval of Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issues of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials

According to article 22 of the Federal law "About Environmental Protection" Government of the Russian Federation decides:

1. Approve the enclosed Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issues of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials.

2. Recognize to invalid:

Item 1 of the order of the Government of the Russian Federation of June 26, 2018 No. 731 "About standard rates of admissible emissions of radioactive materials and standard rates of admissible dumpings of radioactive materials, and also about issue of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials" (The Russian Federation Code, 2018, No. 27, the Art. 4084);

the order of the Government of the Russian Federation of June 2, 2023 No. 916 "About modification of Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issue of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials" (The Russian Federation Code, 2023, No. 24, the Art. 4318).

3. Item 45 of the list of services which are federal executive bodies, bodies of state non-budgetary funds, the state corporations, necessary and obligatory for provision, authority given according to the Federal Laws on provision of the state services in the established field of activity, the state services and are provided by the organizations and the experts authorized in accordance with the legislation of the Russian Federation participating in provision of the state services, No. 352 approved by the order of the Government of the Russian Federation of May 6, 2011 "About approval of the list of services which are federal executive bodies, bodies of state non-budgetary funds, the state corporations, necessary and obligatory for provision, the authority given according to the Federal Laws on provision of the state services in the established field of activity, the state services are also provided by the organizations and the experts authorized in accordance with the legislation of the Russian Federation participating in provision of the state services, and determination of the amount of payment for their rendering" (The Russian Federation Code, 2011, No. 20, Art. 2829; 2015, No. 50, Art. 7189; 2018, No. 27, Art. 4084; 2021, No. 30, of the Art. 5805) to state in the following edition:

"45. Project appraisal of standard rates of admissible emissions of radioactive materials in atmospheric air and (or) the draft of standard rates of admissible dumpings of radioactive materials into water objects regarding their development according to Item 26 of Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issues of permissions to emissions of radioactive materials, permissions to dumpings of the radioactive materials approved by the order of the Government of the Russian Federation of February 2, 2024 No. 99 "About approval of Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials and also issues of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials" <*>.".

4. Determine that data on standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of the radioactive materials established by permissions to emissions of radioactive materials, permissions to dumpings of the radioactive materials operating on the date of entry into force of this resolution are subject to entering into the register of the issued permissions to emissions of radioactive materials in atmospheric air and permissions to dumpings of radioactive materials into water objects which maintaining is performed according to Item 8 of the Rules approved by this resolution without conducting the additional checks confirming reliability of the data entered in the specified register.

5. This resolution becomes effective since September 1, 2024.

6. The rules approved by this resolution are effective 6 years.

Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issues of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials

1. These rules determine procedure for development and establishment of standard rates of admissible emissions of radioactive materials in atmospheric air (further - standard rates of emissions), standard rates of admissible dumpings of radioactive materials into water objects (further - standard rates of dumpings), and also issues of permissions to emissions of radioactive materials in atmospheric air (further - permission to emissions), permissions to dumpings of radioactive materials into water objects (further - permission to dumpings).

2. Development of standard rates of emissions and (or) standard rates of dumpings is performed by the legal entity and (or) the individual entrepreneur operating stationary sources of emissions of radioactive materials in atmospheric air and (or) stationary sources of dumpings of radioactive materials into water objects (further respectively - the job seeker of permission, stationary sources of emissions, stationary sources of dumpings).

3. In case of development of standard rates of emissions and (or) standard rates of dumpings the techniques and (or) methods of development of standard rates of emissions and standard rates of dumpings approved by Federal Service for Environmental, Technological and Nuclear Supervision are applied (further - authorized body).

4. Standard rates of emissions and (or) standard rates of dumpings are developed concerning radioactive isotopes in element form and in the form of the connections included in the list of pollutants to which measures of state regulation in the field of environmental protection, No. 2909-r approved by the order of the Government of the Russian Federation of October 20, 2023 are applied.

5. Development of standard rates of emissions and (or) standard rates of dumpings is performed:
