1. Approve enclosed:

Rules of establishment of supplying and sales and trade allowances to prices for products (goods), implemented in the territories of northern delivery, extreme values of retail and wholesale prices for loads of the first category and products (goods) made with their application, rates for transportation and storage of loads of the first category, pogruzo-unloading works and priyemo-warehouse operations concerning loads of the first category;

changes which are made to the order of the Government of the Russian Federation of March 7, 1995 No. 239 "About measures for streamlining of state regulation of the prices (rates)" (The Russian Federation Code, 1995, No. 11, the Art. 997).

2. This resolution becomes effective from the date of entry into force of the Federal Law "About Northern Delivery".

Rules of establishment of supplying and sales and trade allowances to prices for products (goods), implemented in the territories of northern delivery, extreme values of retail and wholesale prices for loads of the first category and products (goods) made with their application, rates for transportation and storage of loads of the first category, pogruzo-unloading works and priyemo-warehouse operations concerning loads of the first category

1. These rules determine procedure for establishment of supplying and sales and trade allowances to prices for products (goods), implemented in the territories of northern delivery, extreme values of retail and wholesale prices for loads of the first category and products (goods) made with their application, rates for transportation and storage of loads of the first category, pogruzo-unloading works and priyemo-warehouse operations concerning loads of the first category (further respectively - allowances, the prices, rates).

2. The concepts used in these rules are applied in the values established by the Federal Law "About Northern Delivery".

3. Subjects of regulation for the purposes of these rules are understood as the business entities enabling production and (or) the realization of loads of the first category and (or) products (goods) made with their application and (or) the rendering services in transportation and (or) storage of loads of the first category which are carrying out pogruzo-unloading works and (or) priyemo-warehouse operations concerning loads of the first category in the territories of northern delivery.

4. The supreme executive body of the subject of the Russian Federation has the right to make the decision on establishment of allowances, the prices, rates in the territories of northern delivery by types of loads of the first category and (or) products (goods) made with their application, and also on types of service on transportation and storage of loads of the first category and the handling works and priyemo-warehouse operations performed concerning them for certain or uncertain term if regulation of allowances, the prices, rates is not performed by federal bodies of the government.

5. Establishment of allowances, the prices, rates is performed according to the following basic principles:

a) forming of allowances, the prices, rates taking into account the this separate expense accounting, the income and financial results on types of activity, tariff components, the enlarged work types (services), segments of activities of subjects of regulation (natural and exclusive, competitive);

b) establishment of allowances, the prices, rates taking into account cost and the level of profitability for the purpose of ensuring profitability of activities of subjects of regulation;

c) application in all territories of northern delivery of the single principles of regulation of allowances, the prices, rates.

6. In case of establishment of allowances, the prices, rates the following methods are applied:

a) method of economically reasonable expenses (costs);

b) income method of the invested capital;

c) indexation method;

d) method of comparison of analogs.

7. The supreme executive body of the subject of the Russian Federation makes the decision on establishment of allowances, the prices, rates according to the proposal of the subject of regulation or on the offer of executive body of the subject of the Russian Federation in the field of state regulation of the prices (rates).

Changes which are made to the Order of the Government of the Russian Federation of March 7, 1995 No. 239

1. In paragraphs three and the fourth Item 1, in the text of Item 5 of the word "executive bodies" in the corresponding case shall be replaced with words "executive bodies" in the corresponding case.

4. In names of the list of industrial goods, consumer goods and services on which state regulation of the prices (rates) in the domestic market of the Russian Federation is performed by executive bodies of subjects of the Russian Federation and the list of services of transport, supplying and sales and trade organizations on which executive bodies of subjects of the Russian Federation are granted the right to enter state regulation of the rates and allowances approved by the specified resolution words "executive bodies" in the corresponding case shall be replaced with words "executive bodies" in the corresponding case.
