1. Approve the enclosed technical regulation "Requirements to Safety of Fertilizers".

2. Declare invalid the order of the Minister of Agriculture of the Republic of Kazakhstan of April 29, 2020 No. 143 "About approval of the technical regulation "Requirements to Safety of Fertilizers" (it is registered in the Register of state registration of regulatory legal acts No. 20547).

3. To provide to department of agriculture of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the direction of the electronic copy of this order in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after sixty calendar days after day of its first official publication.

Technical regulation "Requirements to Safety of Fertilizers"

Chapter 1. Scope

1. This technical regulation "Requirements to Safety of Fertilizers" (further – the technical regulation) is developed in compliance by the subitem 1) of article 8 of the Law of the Republic of Kazakhstan "About technical regulation" (further – the Law on technical regulation) and extends to mineral, organomineralny, organic fertilizers and soil-improving substances (further – fertilizers), and also to processes of their lifecycle.

2. The list of the fertilizers falling under action of the technical regulation and their codes on the qualifier according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union is specified in appendix 1 to this technical regulation.

3. The risks connected with fertilizers are caused by the following dangerous factors:

for mineral fertilizers:

1) combustibility;

2) the oxidizing impact;

3) corrosive attack;

4) toxicity;

5) injury of eyes;

6) corrosion of skin;

7) irritation of eyes and skin;

8) danger to the water environment;

9) danger to the air environment and soil;

10) radioactive radiation (for phosphoric fertilizers and soil-improving substances);

for organic and organomineralny fertilizers:

1) bacteriological;

2) parasitological;

3) entomological.

Chapter 2. Terms and determinations

4. In this technical regulation the following terms with the corresponding determinations are used:

1) nitrogen fertilizer – the fertilizer containing nitrogen in usvoyaemy plants to form;

2) the manufacturer – the legal entity registered according to the legislation of the Republic of Kazakhstan or state member of the Eurasian Economic Union or the physical person registered as the individual entrepreneur, performing on its own behalf production or production and sales of products;

3) person authorized by the manufacturer – the legal entity registered according to the legislation of the Republic of Kazakhstan or state member of the Eurasian Economic Union or the physical person registered as the individual entrepreneur who based on the contract with the manufacturer, including with the foreign manufacturer, performs actions on behalf of this manufacturer in case of assessment of conformity and release into the stream of commerce of products in the territory of the Republic of Kazakhstan;
