About approval of the Regulations on authorization of persons having the right to perform actuarial activities in the sphere of insurance, and persons who can carry out obligations of the responsible actuary

According to Articles 15, 55-1, 56 of the Law of Ukraine "About the National Bank of Ukraine", article 21 of the Law of Ukraine "About financial services and finance companies", Articles 3, of 16, of 31, of 114, of Item 25 of the Section XV of the Law of Ukraine of November 18, 2021 No. 1909-IX "About insurance", for the purpose of introduction of system of authorization of persons having the right to perform actuarial activities in the sphere of insurance and persons who can fulfill duties of the responsible actuary the Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on authorization of persons having the right to perform actuarial activities in the sphere of insurance and persons who can carry out obligations of the responsible actuary (further - Provisions) which is applied.

2. The requirement about stay of person in the Register of persons having the right to perform actuarial activities in the sphere of insurance, and persons who can carry out obligations of the responsible actuary (further - the Register), at least within two last years before date of submission by the applicant of the statement for inclusion in the Register, or change of data in the Register concerning acquisition of the status of the actuary, in the form established in appendix 3 to the Provision (further - the statement) and the documents attached to it for inclusion in Registers/changes of data in the Register on skill level of person, established, in the paragraph the second the subitem 3 of Item 25 of the Section III of Provisions, is not applied within three years from the date of entry into force of this resolution.

3. Person who on the date of entry into force of this resolution has the existing certificate on compliance to qualification requirements to persons who can be engaged in actuarial calculations and is not included in the list of actuaries in the sphere of insurance with skill level which provides the right to be engaged in actuarial calculations on types of insurance of others, than life insurance and to certify them and/or the right to be engaged in actuarial calculations on life insurance and to certify them, within two years from the date of enforcement of the Law of Ukraine of November 18, 2021 No. 1909-IX "About insurance" shall perform procedure for registration by submission to the National Bank of Ukraine (further - National Bank) the statement and the filled questionnaire (in the form established in appendix 4 to the Provision).

4. Person who submitted the application and questionnaire according to Item 3 of this resolution is considered included in the Register from date of issue to it in statements from the Register of persons having the right to perform actuarial activities in the sphere of insurance, and persons who can carry out obligations of the responsible actuary, in the form established in appendix 5 to the Provision (dalee-Vypiska from the Register), except the cases determined in Item 5 of this resolution with such skill level:

1) person having the existing certificate on compliance to qualification requirements to persons who can be engaged in actuarial calculations on types of insurance of others than life insurance and to certify them, it is considered included in the Register with skill levels as person with the right to perform actuarial activities in the sphere of insurance (further - person having the right to be engaged in actuarial activities) and as person with the right to fulfill duties of the responsible actuary on classes of insurance of other, than life insurance (further - the actuary with the right to be responsible for insurance of other, than life insurance);

2) person having the existing certificate on compliance to qualification requirements to persons who can be engaged in actuarial calculations on life insurance and certify them, person with the right to fulfill duties of the responsible actuary on life insurance classes is considered included in the Register with skill levels as person having the right to be engaged in actuarial activities" and as (further - the actuary with the right to be responsible for life insurance);

3) person having the existing certificate on compliance to qualification requirements to persons who can be engaged in actuarial calculations (without restriction of term of its action) is considered included in the Register with skill levels as person having the right to be engaged in actuarial activities the actuary with the right to be responsible for insurance of other, than life insurance, and the actuary with the right to be responsible for life insurance.

The National Bank within 30 calendar days from the date of obtaining on behalf of the statement and the filled questionnaire according to Item 3 of this resolution, except the cases determined in Item 5 of this resolution includes such face in the Register and sends to such person the Statement from the Register. The certificate of such person is considered cancelled from the date of inclusion in the Register.
