About procedure for enforcement of changes in the technical regulation of the Customs union "Safety requirement of nutritional supplements, fragrances and technological supportive applications" (TR CU 029/2012)

1. Determine that:

a) documents (data) on assessment of conformity of nutritional supplements (including complex), fragrances and technological supportive applications, the food products containing nutritional supplements, fragrances and residual amounts of technological supportive applications concerning which the Decision of Council of the Eurasian economic commission of August 29, 2023 No. 84 makes the changes concerning the mandatory requirements established by the technical regulation of the Customs union "Safety requirement of nutritional supplements, fragrances and technological supportive applications" (TR CU 029/2012) made by the Decision of Council of the Eurasian economic commission of July 20, 2012 No. 58, the Decisions of Council of the Eurasian economic commission issued or made before the effective date of August 29, 2023 No. 84, are valid before the termination of term of their action, but no later than 36 months from the effective date Decisions of Council of the Eurasian economic commission of August 29, 2023 No. 84;

b) production and release into the stream of commerce on customs area of the Eurasian Economic Union of nutritional supplements (including complex), fragrances and technological supportive applications, the food products containing nutritional supplements, fragrances and residual amounts of technological supportive applications concerning which the Decision of Council of the Eurasian economic commission of August 29, 2023 No. 84 makes the changes concerning the mandatory requirements established by the technical regulation of the Customs union "Safety requirement of nutritional supplements, fragrances and technological supportive applications" (TR CU 029/2012) made by the Decision of Council of the Eurasian economic commission of July 20, 2012 No. 58, in the presence of documents (data) on assessment of conformity specified in the subitem "an" of this Item Decisions of Council of the Eurasian economic commission of August 29, 2023 are allowed No. 84 within 36 months from the effective date;

c) production and release into the stream of commerce on customs area of the Eurasian Economic Union of the food products containing nutritional supplements, fragrances and residual amounts of technological supportive applications, from the effective date Decisions of Council of the Eurasian economic commission of August 29, 2023 No. 84 in the presence of documents (data) on assessment of conformity of such nutritional supplements (including complex), fragrances and technological supportive applications specified in the subitem "an" of this Item are allowed;

d) marking of nutritional supplements (including complex), fragrances and technological supportive applications, and also the food products containing nutritional supplements, fragrances and residual amounts of technological supportive applications concerning which the Decision of Council of the Eurasian economic commission of August 29, 2023 No. 84 makes the changes concerning the mandatory requirements established by the technical regulation of the Customs union "Safety requirement of nutritional supplements, fragrances and technological supportive applications" (TR CU 029/2012) made by the Decision of Council of the Eurasian economic commission of July 20, 2012 No. 58, in the presence of documents (data) on assessment of conformity specified in the subitem "an" of this Item No. 84 is allowed according to earlier established mandatory requirements to their marking within 36 months from the effective date of the Decision of Council of the Eurasian economic commission of August 29, 2023;

e) the address of the nutritional supplements specified in subitems "b" and "v" of this Item (including complex), fragrances and technological supportive applications, and also the food products containing nutritional supplements, fragrances and residual amounts of technological supportive applications is allowed during expiration date of such nutritional supplements (including complex), fragrances, technological supportive applications and such products, established by their manufacturer.

2. This Decision becomes effective after 30 calendar days from the date of its official publication, but not earlier than the date of entry into force of the Decision of Council of the Eurasian economic commission of August 29, 2023 No. 84.
