Some questions of payment of housing subsidies and privileges to citizens for payment of housing and communal services, acquisition of solid and liquid oven household fuel and the liquefied gas

According to part seven of Article 20 of the Budget code of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for use of the means provided in the Government budget on payment of housing subsidies and privileges to citizens for payment of housing and communal services, acquisition of solid and liquid oven household fuel and the added liquefied gas.

2. Bring the enclosed changes in resolutions of the Cabinet of Ministers of Ukraine.

3. This resolution becomes effective since January 1, 2024, but not earlier than day of its publication.

Procedure for use of the means provided in the government budget on payment of housing subsidies and privileges to citizens for payment of housing and communal services, acquisition of solid and liquid oven household fuel and the liquefied gas

1. This Procedure determines the mechanism of use of the means provided in the Government budget according to the budget program "Payment of Housing Subsidies and Privileges to Citizens for Payment of Housing and Communal Services, Acquisition of Solid and Liquid Oven Household Fuel and the Liquefied Gas" (further - budgetary funds).

2. The main manager of budgetary funds is Minsotspolitiki.

Manager of budgetary funds of the lowest level and the executive in charge of the budget program is the Pension fund of Ukraine (further - Fund).

3. Budgetary funds are allocated on:

1) payment of housing subsidies for payment of housing and communal services, acquisition of solid and liquid oven household fuel and the liquefied gas (further - housing subsidy) according to the Regulations on procedure for purpose of housing subsidies approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 1995 No. 848 "About simplification of procedure for provision to the population of subsidies for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel" (ZP of Ukraine, 1996, No. 2, Art. 76; Official Bulletin of Ukraine, 2000, No. 5, Art. 178; 2019, No. 69, Art. 2390);

2) payment to citizens of privileges for payment of housing and communal services, acquisition of solid and liquid oven household fuel and the liquefied gas (further - privileges) according to Procedure for provision of privileges for payment of housing and communal services, acquisition of the solid fuel and the liquefied gas in cash approved by the resolution of the Cabinet of Ministers of Ukraine of April 17, 2019 No. 373 "Some questions of provision of housing subsidies and privileges for payment of housing and communal services, acquisition of solid fuel and the liquefied gas in cash" (The Official Bulletin of Ukraine, 2019, No. 36, Art. 1263; 2020, No. 3, Art. 161);

3) payment to citizens of funds of additional support for acquisition of solid oven household fuel (further - additional support) according to procedure for realization during the heating season of 2023-2024 of the pilot project on provision of additional support to the population on acquisition of the solid oven household fuel approved by the resolution of the Cabinet of Ministers of Ukraine of November 7, 2023 No. 1173 (The Official Bulletin of Ukraine, 2023, No. 103, the Art. 6154);

4) payment of the expenses connected with payment of housing subsidies, privileges and additional support through separate division (branch, representation, department, etc.) of the organization performing payment and delivery of pensions and the monetary assistance in the place of the actual accommodation of receivers within Ukraine and according to the legislation has the right to provide such services (further - vyplatny object).

4. Budgetary funds in the direction specified in the subitem of 1 Item 3 presents of the Procedure are transfered to account Fonda opened in JSC Oschadbank with the subsequent transfer in coordination with Minsotspolitiki in accordance with the established procedure into the accounts of receivers of housing subsidies opened in organization of authorized bank or through payable objects.

Head departments of Fund in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol (further - head departments of Fund) calculate monthly to 22 numbers of the amount of housing subsidies for current month.

On the basis of the corresponding calculations of head departments of Fund on a centralized basis the fund creates the request about the need for budgetary funds for payment of the housing subsidies and requirement for fee connected with payment and delivery of housing subsidies through payable objects in which the available remaining balance of funds on accounts for the specified purposes and the returned unpaid means (separately - on payment of housing and communal services is considered, separately - on acquisition of solid and liquid oven household fuel and the liquefied gas.

The fund transfers budgetary funds for payment of housing subsidies to receivers:

into the accounts opened in authorized banks - to the 5th following after month for which housing subsidies are added;

through payable objects - to the 25th following after month for which housing subsidies, according to the schedule of pension payment and the monetary assistance to receivers are added.

5. The budgetary funds of housing subsidy which are not paid to the receiver are considered by head departments of Fund when calculating housing subsidy for the next period.

Means of excessively listed (paid) housing subsidy return the receiver to the account of Fund opened in JSC Oschadbank.

Means of housing subsidies for the last budget periods returned into the account of Fund opened in JSC Oschadbank no later than the 10th following last quarter and no later than December 26 of the current year return to the registration account of Fund opened in treasury.

The funds which arrived in the accounting period for the registration account of Fund opened in treasury for the operations performed in last budget periods go to the income of the government budget.

6. Budgetary funds in the direction specified in the subitem 2 Items 3 presents of the Procedure are transfered to account Fonda opened in JSC Oschadbank with the subsequent transfer in coordination with Minsotspolitiki in accordance with the established procedure into the accounts of receivers of privileges opened in organization of authorized bank or through payable objects.

Head departments of Fund monthly to the 25th calculate the amounts of privileges for current month.
