About measures for reducing mandatory requirements, simplification of licensed and allowing procedures in the field of entrepreneurship

For the purpose of ensuring execution of the priority tasks determined within open dialogue of the President of the Republic of Uzbekistan with entrepreneurs who is carried out on August 18, 2023 and also reducing mandatory requirements by assessment of their regulatory impact, simplification of licensed and allowing procedures:

1. Agree with the offer of the Ministry of Justice, Ministry of Economics and finance Authorized on protection of the rights and legitimate interests of subjects of entrepreneurship and Chamber of Commerce and Industry about cancellation since March 1, 2024 of some types of the licensed activities and documents of allowing nature according to appendix No. 1.

2. Determine that since March 1, 2024:

legal entities in case of voluntary payment within fifteen days of 50 percent from the size of the amount of the penalty imposed on them for making of offenses in the field of licensing, allowing and notifying procedures within thirty days - 70 percent are exempted from payment of the rest of penalty;

the procedure for remote assessment of conformity of applicants to requirements and conditions of licenses and documents of allowing nature by video conference takes root into process of licensing or the document of allowing nature;

the subject of entrepreneurship is allowed to specify the place of stay of the founder as the postal address in case of its state registration or re-registration.

3. Cancel the following procedures and requirements:

reservation in Fund of safe tourism of means in equivalent of 15 thousand US dollars for implementation of tourist activities for the "outbound tourism" direction by implementation for tour operators of procedure for compulsory insurance of risk in case of emergency situations;

appendix of documents of title on real estate to the statement for certification of means of placement, ski slopes and beach services in case of certification of tourist services;

determination of Public service of traffic safety of venues of technical inspection of vehicles of legal entities by territorial departments;

availability of buildings on the property right or other corporeal right when implementing activities for advanced training and retraining of personnel only in exit form.

4. Implement from March 1, 2024 to January 1, 2025 according to the procedure of legal experiment the special mode "In Business without License" (further - the Special mode) determining up to three months the transition and adaptation period to start activities for operation of the x-ray equipment and implementation of veterinary laboratory and diagnostic works.

5. Determine that within the Special mode:

a) during three-months term it is allowed to perform the activities specified in item 4 of this Decree without receipt of the license and the document of allowing nature with the free notification of authorized body by means of the information system "License";

b) subjects of entrepreneurship and their officials during term up to three months since the beginning of the direction of the notification in accordance with the established procedure are not made responsible for implementation of activities without license and the document of allowing nature;

c) subject of entrepreneurship which began the activities specified in item 4 of this Decree with the notification of authorized body during term up to three months:

takes measures for reduction of the activities in compliance with requirements and conditions of the license or allowing procedures;

obtains the corresponding license or the document of allowing nature in accordance with the established procedure or stops implementation of these activities.

To the Ministry of Justice together with authorized bodies till November 1, 2024 on the basis of the analysis of results of legal experiment to make in the Cabinet of Ministers offers on complete implementation of the Special mode and its application also to other types of activity.

6. Approve:

The plan of evaluating regulatory impact of regulatory legal acts in 2024 according to appendix No. 2;

"Road map" on reducing mandatory requirements, and also simplification of procedures of receipt of the license and documents of allowing nature according to appendix No. 3;

The schedule of development of passports of separate licensed, allowing and notifying procedures according to appendix No. 4.

7. Assign to heads of responsible state bodies and organizations the personal responsibility for:

evaluating regulatory impact of regulatory legal acts in the terms specified in appendix No. 2 to this Decree and entering into the Ministry of Justice of the reports of assessment developed by their results and also reasonable offers;

timely and high-quality accomplishment of the actions determined in appendices No. No. 3 and 4 to this Decree.

8. To the Ministry of Justice together with the interested ministries and departments in three-months time to make in the Cabinet of Ministers offers on the changes and amendments in acts of the legislation following from this Decree.

9. Discussion of course of execution of this Decree, implementation of coordination and control of activities of the departments responsible for its execution to assign to the Prime Minister of the Republic of Uzbekistan A. N. Aripov.
