Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of traffic.

Article 2. Legislation on traffic

The legislation on traffic consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about traffic then are applied rules of the international treaty.

Article 3. Concept of the road

The road are the land areas equipped, adapted for movement of vehicles and pedestrians and allocated for placement of complex of the road objects intended for safety control of movement of vehicles and pedestrians and space over them.

Roads are divided into highways public (further - public roads), streets of areas (cities), settlements, kishlaks and auls, economic roads, ways of urban electric transportation, bicycle and pedestrian walkways.

The roads lying in the rural zone and connecting among themselves farms are intereconomic rural highways.

Article 4. Basic concepts

In this Law the following basic concepts are applied:

road objects - artificial road features (bridges, overpasses, platforms, pipes, tunnels and other engineering constructions), the protective constructions (devices for protection of roads against avalanches, collapses, landslides and other devices) which are structural elements of the road and also elements of arrangement of roads (stopping platforms, pavilions for passengers, platforms of rest, the place of parking of vehicles and others);

the owner of the road - the companies, organizations, the organizations or physical persons under which authority the road is;

traffic - set of the public relations arising with participation of vehicles and participants of traffic within roads under the organization of traffic;

the participant of traffic - person which is directly involved in the course of traffic as the driver, the passenger of the vehicle or the pedestrian;

traffic monitoring - accounting, generalization, processing and information analysis about the main indicators and about condition of technical means of the organization of traffic;

the organization of traffic - complex of organization-legal, organizational and technical actions and administrative actions for management of traffic and safety control of traffic;

project audit of the organization of traffic - check of results of organization activity when designing (irrespective of the project organization), construction, reconstruction, repair and road maintenance on compliance to the existing requirements of normative and technical documents for the organization of traffic;

technical means of the organization of traffic - the devices and constructions intended for the organization of traffic (route signs, driving lanes, traffic lights, flashing indicators, road marking, traveling columns, barriers, speed limiters, barriers, islands of safety, system (means) of autocontrol of traffic, and also other devices and constructions);

traffic safety - the traffic condition reflecting degree of security of his participants from the road accidents and their effects;

road capacity - the highest rate of traffic load of vehicles in one direction on certain road stretch;

the road accident - the event which happened in the course of traffic of the vehicle and to its participation with which there came death or harm is done to health of citizens, vehicles, constructions, loads are damaged or other material damage is caused;

the railway crossing - the place of crossing of the road with railway tracks at one level;

the vehicle - the device intended for movement or transportation across roads of passengers, baggage, cargo baggage, loads, post and express departures or the equipment for implementation of special works;

places of parking of vehicles (further - places of parking) - the road stretch having local broadening of the carriageway, the building, construction (their part), the special open area intended for temporary or permanent storage of vehicles;

the driver - person managing the vehicle. When training in vehicle control by the driver the training person is considered.

Article 5. The basic principles in the field of traffic

The basic principles in the field of traffic are:

legality;

systemacity;

scientific character;

openness and publicity;

priority of protection of life and health of citizens;

priority of ecological safety and environmental protection;

accounting of opinion of local population and participants of traffic.

Chapter 2. Regulation in the field of traffic

Article 6. Public administration in the field of traffic

Public administration in the field of traffic is exercised of the Cabinet of Ministers of the Republic of Uzbekistan, public authorities on places and specially authorized state bodies in the field of traffic.

In the field of traffic (further - specially authorized state bodies) the Ministry of transport of the Republic of Uzbekistan and its subordinated organizations, Security of traffic of Department of public safety of the Ministry of Internal Affairs of the Republic of Uzbekistan, management of traffic safety of service of public safety of the Ministry of Internal Affairs of the Republic of Karakalpakstan, Main Departments of Internal Affairs of the city of Tashkent and Tashkent region, Departments of Internal Affairs of areas, and also divisions of traffic safety of service of public safety of district (city) Departments of Internal Affairs (managements of coordination of activities of law-enforcement bodies) (further - Public service of traffic safety), Public service of safety of the President of the Republic of Uzbekistan treat specially authorized state bodies, Customs committee under the Ministry of Economics and finance of the Republic of Uzbekistan.

Article 7. Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of traffic

Cabinet of Ministers of the Republic of Uzbekistan:

approves state programs in the field of traffic and provides their realization;

within the powers develops and adopts regulatory legal acts in the field of traffic;

coordinates activities of state bodies, executive bodies on places in the field of traffic;

determines the list of the specialties, professions and positions connected with the sphere of traffic and also qualification requirements to them;

approves procedure for forming, accounting and use of the main indicators of the organization of traffic;

establishes single requirements to technical condition of vehicles and roads, traffic safety on roads and railway crossings;

establishes general requirements to training of transport drivers, and also training of the population in Traffic regulations;

approves single system of accounting of drivers, vehicles, road traffic offenses, road accidents and other data in the field of traffic.

The Cabinet of Ministers of the Republic of Uzbekistan can perform also other powers according to the legislation.

Article 8. Powers of public authorities on places in the field of traffic

Public authorities on places:

participate in implementation of state programs in the field of traffic;

develop, approve territorial programs in the field of traffic and provide their realization;

will organize and perform monitoring of traffic on intereconomic rural highways, on streets of areas (cities), settlements, kishlaks and auls;

keep the register of places of the parking located on intereconomic rural highways, on streets of areas (cities), settlements, kishlaks and auls, including paid places of parking;
