About determination of separate categories of the foreign citizens and stateless persons having the right to file the application for admission in citizenship of the Russian Federation

For the purpose of protection of rights and freedoms of man and citizen, being guided by the conventional principles and rules of international law, according to item 4 of part 1 of article 28 of the Federal Law of April 28, 2023 "About citizenship of the Russian Federation" I decide No. 138-FZ:

1. Grant the right to file the application for admission in citizenship of the Russian Federation according to part 9 of article 16 of the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation" without observance of the requirements provided by Items 1 - 3 parts 1 of article 15 of the called Federal Law, to the following foreign citizens and stateless persons including which earlier had citizenship of the Russian Federation and who drew up getting out of citizenship of the Russian Federation in accordance with the established procedure:

a) to the citizens of Ukraine who do not have nationality (citizenship) of other state, born and constantly living in the territories of the Republic of Crimea and Sevastopol, left the specified territories till March 18, 2014 and also their children including adopted (adopted), to spouses and parents (irrespective of their nationality);

b) to the persons without citizenship who were born and constantly living in the territories of the Republic of Crimea and Sevastopol, left the specified territories till March 18, 2014 and also their children including adopted (adopted), to spouses and parents (irrespective of their nationality);

c) to the citizens of Ukraine and stateless persons having the document confirming the right to stay (residence) in the Russian Federation (the migration card, permission to temporary residence, permission to temporary residence for the purpose of education, the residence permit, the certificate of the refugee, the certificate on provision of provisional asylum in the territory of the Russian Federation (further - the certificate on provision of provisional asylum), or the certificate of the participant of the State program on rendering assistance to voluntary resettlement to the Russian Federation the compatriots living abroad (further - the certificate of the participant of the State program), constantly living in the territory of Ukraine, and also to their children including adopted (adopted), to spouses and parents (irrespective of their nationality);

d) to foreign citizens and stateless persons which or relatives on the direct ascending line, adoptive parents or spouses of which were subjected to illegal deportation from the territory Crimean by the ASSR, and also to their relatives on the direct descending line, the adopted (adopted) children and spouses (irrespective of their nationality);

e) to the citizens of Afghanistan, the Republic of Iraq, the Republic of Yemen and the Syrian Arab Republic who were born in the territory of RSFSR and having citizenship of the USSR in the past and also their children including adopted (adopted), to spouses and parents (irrespective of their nationality).

2. Establish, that temporarily staying, constantly or the orphan children and children without parental support, incapacitated persons who are the citizens of Ukraine or persons without citizenship who were constantly living in the territory of Ukraine temporarily living in the Russian Federation acquire citizenship of the Russian Federation according to part 9 of article 16 of the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation".

3. With the application for admission in citizenship of the Russian Federation the children and incapacitated persons called in Item 2 of this Decree having the right to address:

a) the guardian or the custodian of the child or the guardian of incapacitated person who are the citizens of the Russian Federation, and also the citizens of Ukraine who are temporarily staying, constantly or temporarily living in the Russian Federation including acquiring citizenship of the Russian Federation according to the subitem "v" of Item 1 of this Decree, except for case of establishment of guardianship or custody based on the joint statement of parents on appointment to their child of the guardian or the custodian for the period during which on reasonable excuses they will not be able to fulfill the parental responsibilities;

b) the head of the Russian organization for orphan children and children without parental support in which under supervision the child, the Russian educational organization, the medical organization, the organization rendering social services or other Russian organization in which under supervision incapacitated person, except for the case provided by part 4 of article 11 of the Federal Law of April 24, 2008 No. 48-FZ "About guardianship and custody" is placed is placed.
