About the organization and functioning of the Agency on management of highly specialized social services and reorganization of some public organizations which are under its authority

1. Rename the National agency of the public assistance - the administrative authority subordinated to the Ministry of Labour and Social Protection, into Agency on management of highly specialized social services - the administrative authority subordinated to the Ministry of Labour and Social Protection.

2. Approve:

1) Regulations on the organization and functioning of the Agency on management of highly specialized social services according to appendix No. 1;

2) Structure of the Agency on management of highly specialized social services according to appendix No. 2;

3) to Organigramm Agentstva on management of highly specialized social services according to appendix No. 3;

4) the List of the public organizations which are under authority of the Agency on management of highly specialized social services in which the Ministry of Labour and Social Protection is founder, according to appendix No. 4.

3. Establish the extreme number of staff of the Agency on management of highly specialized social services in number of 2202 units.

4. Release of personnel of the National agency of the public assistance in connection with limiting reducing manpower ceiling and liquidation of positions, in case of impossibility of its translation, shall be performed according to provisions of the Law No. 158/2008 on the state position and the status of the government employee or the Labor code of the Republic of Moldova No. 154/2003, depending on circumstances. To provide expenses on release of personnel for the account and within the financial resources approved in the budget of the National agency of the public assistance.

5. The order of the Government No. 1263/2016 about approval of the Regulations on the organization and functioning of the National agency of the public assistance, its structure and the extreme number of staff (2016, No. 405 - 414, Art. 1361), with subsequent changes, to declare the official monitor of the Republic of Moldova invalid.

6. Kochiyer of the area Dubesar to reorganize the center of placement for aged persons and persons with limited opportunities of the commune by merging (accession) with the Center of temporary placement for persons with limited opportunities (adults) of the commune Kochiyer of the area Dubesar (the attached legal entity).

7. To give property of the attached legal entity to the Center of placement for aged persons and persons with limited opportunities of the commune Kochiyer of the area Dubesar according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015.

8. Release of personnel in connection with reorganization of the legal entities specified in Item 6, shall be performed according to the labor law in case of impossibility of its translation. To provide expenses on release of personnel for the account and within financial resources of the Center of placement for aged persons and persons with limited opportunities of the commune Kochiyer of the area Dubesar.

9. Rename the Center of temporary placement for children with limited opportunities, mun. Hynchesht, in the Center of temporary placement for persons with limited opportunities, mun. Hynchesht.

10. Rename the Center of temporary placement for children with limited opportunities, mun. Orkhey, in the Center of temporary placement for persons with limited opportunities, mun. Orkhey.

11. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on the organization and functioning of the Agency on management of highly specialized social services

I. General provisions

1. The regulations on the organization and functioning of the Agency on management of highly specialized social services (further - the Provision) regulate mission, fields of activity, functions, powers and the rights of the Agency on management of highly specialized social services (further - the Agency), and also procedure for its organization and functioning.

2. The agency is the administrative authority subordinated to the Ministry of Labour and Social Protection responsible for management of highly specialized social services and realization of state policy in the fields of activity entrusted to it.

3. The agency is legal entity of the public law, owns treasurer accounts, seal with the image of the State Emblem of the Republic of Moldova and other attributes characteristic of state bodies established by the legislation. The Agency location - in municipium of Chisinau.

4. In implementation process of state policies according to fields of activity the Agency cooperates with the central and local industry authorities.

5. Financing and material logistics of the Agency is performed at the expense of the government budget and other means which are not forbidden by the legislation.
