About approval of some acts of the legislation regulating activities of the state inspectorate for control of safety of objects of water economy under the Cabinet of Ministers of the Republic of Uzbekistan

For the purpose of ensuring execution of the resolution of the President of the Republic of Uzbekistan of April 22, 2021 No. PP-5090 "About measures for the organization of activities of the State inspectorate for control of safety of objects of water economy under the Cabinet of Ministers of the Republic of Uzbekistan" the DECIDES: Cabinet of Ministers

1. Approve:

a) Regulations on the State inspectorate for control of safety of objects of water economy under the Cabinet of Ministers of the Republic of Uzbekistan according to appendix No. 1 *, providing:

status, main objectives and functions of the State inspection Gosvodkhoznadzor;

procedure for the organization of activities, financing of the State inspectorate Gosvodkhoznadzor, compensations of her employees and their financial incentive;

rights and responsibility of the State inspection Gosvodkhoznadzor, and also main functional objectives and responsibility of heads;

b) Regulations on Advisory council under the State inspectorate for control of safety of objects of water economy under the Cabinet of Ministers of the Republic of Uzbekistan according to appendix No. 2 *, providing:

procedure for the organization of activities of Advisory council and forming of its structure;

main objectives, rights and obligations of Advisory council;

c) Regulations on procedure for financial incentive of staff of the State inspectorate for control of safety of objects of water economy under the Cabinet of Ministers of the Republic of Uzbekistan according to appendix No. 3 *, providing:

procedure of awarding of employees and rendering financial support to them at the expense of means of the Government budget of the Republic of Uzbekistan and fund of development of water economy under the Ministry of water economy;

cases and bases of awarding of employees, and also rendering financial support to them;

procedure for determination of sources of financing of actions for encouragement of employees;

d) The list of objects of water economy with the high level of danger according to appendix No. 4*.

Determine that the financial incentive of staff of the State inspectorate for control of safety of objects of water economy under the Cabinet of Ministers of the Republic of Uzbekistan is financed by means of the Government budget of the Republic of Uzbekistan and fund of development of water economy under the Ministry of water economy.

2. Make changes and addition to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 5.

3. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 6.

4. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan concerning development of agrarian and food spheres Ganiyev Sh. M.

The changes and amendment brought in some decisions of the Government of the Republic of Uzbekistan

1. In the resolution of the Cabinet of Ministers of November 16, 1999 No. 499 "About measures for implementation of the Law of the Republic of Uzbekistan "About safety of hydraulic engineering constructions" (the joint venture of the Republic of Uzbekistan, 1999, No. 11, the Art. 66):

a) state Item 2 in the following edition:

"2. Determine that control and supervision of technical condition and safety of operation of the hydraulic engineering constructions with the high level of danger belonging to I, II and III classes is performed by the State inspection Gosvodkhoznadzor under the Cabinet of Ministers of the Republic of Uzbekistan (further - the State inspection Gosvodkhoznadzor), and it is lower than III classes of hydraulic engineering constructions - the Ministry of water economy of the Republic of Uzbekistan, JSC Thermal Power Plants, JSC Uzbekgidroenergo and other organizations for accessory of constructions";

b) the paragraph one of Item 5 to state in the following edition:

"5. To the ministry of water economy of the Republic of Uzbekistan, JSC Thermal Power Plants, JSC Uzbekgidroenergo, the organizations in which system there are hydraulic engineering constructions:";

c) to state paragraph two of Item 2 of appendix No. 1 in the following edition:

"The hydraulic engineering constructions I, II, III of classes with the high level of danger which are belonging to I, II and III classes, being in state-owned property, logging in republican regional water management and energy are subject to declaring, and also hydraulic engineering constructions it is lower than III classes, constituting the increased danger in case of emergency situations which list is determined by the declaring organization in coordination with the State inspection Gosvodkhoznadzor;

d) in appendix No. 2:

state Items 12 and 13 in the following edition:

"12. Forms on contents of the Inventory of hydraulic engineering constructions affirm the State inspection Gosvodkhoznadzor in coordination with the Ministry of water economy of the Republic of Uzbekistan, JSC Thermal Power Plants, JSC Uzbekgidroenergo in relation to type of the specific hydraulic engineering construction (water storage basin, selekhranilishche, pumping point, the water-engineering system, the channel, collector and others).

13. Maintaining the Inventory of the hydraulic engineering constructions with the high level of danger which are belonging to I, II, the III class, being in state-owned property, and also logging in republican and regional water management and energy is performed by the State inspection Gosvodkhoznadzor, and on other hydraulic engineering constructions it is lower than III classes - the Ministry of water economy of the Republic of Uzbekistan, JSC Thermal Power Plants, JSC Uzbekgidroenergo of accessory of constructions".
