About measures for ensuring transparency of accounting of the rights to real estate, and also enhancement of separate ministerial procedures in the sphere of the inventory

For the purpose of further enhancement of procedures for rendering separate state services in the sphere of the inventory, implementation of the principle of transparency when accounting real estate and the rights relating to it, and also ensuring execution of the State program on strategy implementation of development of New Uzbekistan for 2022-2026 in "Year of ensuring interests of the person and development waved", the Republic of Uzbekistan approved by the Presidential decree of January 28, 2022 the No. UP-60, DECIDES: Cabinet of Ministers

1. Take into consideration that according to Item 46.3 of the State program on strategy implementation of development of New Uzbekistan for 2022-2026 in "Year of ensuring interests of the person and development waved", the Republic of Uzbekistan approved by the Presidential decree of January 28, 2022 No. UP-60, provides determination of structure of the open rights to real estate granted in the state register (further - open data), implementation of the public geoportal based on open data, and also development of procedure for data presentation to physical persons and legal entities through the National geographic information system (further - information system).

2. Determine that:

The agency according to the inventory under the State Tax Committee of the Republic of Uzbekistan (further - the Agency according to the inventory) in information system keeps the public geoportal based on open data;

works on preparation of cadastral case on real estate units are carried out only in electronic form through information system;

the technical and program requirements imposed to use of information system by cadastral engineers and connection to it, and also information security policy it is performed by the Agency according to the inventory;

for use of information system by the cadastral engineers having the competence certificate monthly payment in off-budget fund of the Agency according to the inventory in single size of basic settlement size based on the agreement signed with the Agency according to the inventory is performed;

the payments made by cadastral engineers are spent for development of information and communication technologies of the Agency in the inventory, maintaining and technical support of information system.

3. Approve Regulations on procedure for provision of the open rights to real estate granted the state register through the National geographical information system according to appendix No. 1, providing:

procedure for provision of open data through the public geoportal to state bodies on free basis, and to physical persons, economic associations and other legal entities - on paid basis;

creation of possibility of free obtaining by users of data of the state register of the rights to real estate on cadastral number of the parcel of land, its address and purpose of its use;

conditions and terms of provision of open data;

payment procedure for open data, their accounting and distribution of receipts;

tasks of the operator of the public geoportal.

4. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent till January 1, 2024:

finish works on registration in accordance with the established procedure of the parcels of land which are actually used by state bodies and the organizations, and also self-government institutions of citizens, but on which the decision on allotment of land is not made;

together with the Ministry of housing-and-municipal servicing and the Ministry of construction of the Republic of Uzbekistan based on the monthly schedule to provide the direction of the corresponding addresses on behalf of owners of placements of the apartment house to public authorities on places, determination on their basis of arrangement of the apartment house and borders and the sizes of the parcel of land adjoining to it, and also establishment and state registration of the rights of owners of placements of the apartment house on permanent use of the parcel of land.

5. To provide to authorized bodies on maintaining the state inventories until the end of 2022 complete integration of the databases with information system.

Together with the Ministry of development of information technologies and communications, the Agency of the inventory, the Ministry of Justice of the Republic of Uzbekistan and other interested ministries and departments to provide integration of administrative regulations of rendering the state services in the sphere of the inventory with system of rendering the state services in a month, and also implementation through the Single portal of interactive state services of the Republic of Uzbekistan.

6. To the agency according to the inventory:

in three-months time to take measures for upgrade of information systems of the Agency for the inventory with creation of possibility of automation of processes of preparation by cadastral engineers of cadastral case, including primary cadastral case on real estate units, and also conducting monitoring;

till December 1, 2022 according to the resolution of the President of the Republic of Uzbekistan of December 7, 2020 No. PP-4913 "About additional measures for attraction of private sector to the spheres regulated by the state" to make in the Cabinet of Ministers the offer on results of the experiment made in the Tashkent region and the city of Tashkent in the sphere of preparation of cadastral case;

till January 1, 2023 to start the public geoportal based on open data;

in two-month time together with the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution.

7. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

8. To impose control of execution of this resolution on the deputy prime minister on financial and economic questions and reducing poverty - the Minister of Economic Development and reducing poverty of Kuchkarov D. A. and chairman of the State Tax Committee of the Republic of Uzbekistan Kudbiyev Sh. D.

Regulations on procedure for provision of the open rights to real estate granted the state register through the National geographical information system

Chapter 1. General provisions

1. This Provision determines procedure for provision of the open rights to real estate granted the state register (further - open data) to state bodies and economic to associations, physical and other legal entities through the National geographical information system of the Republic of Uzbekistan (further - information system) the Agencies by the inventory under the State Tax Committee of the Republic of Uzbekistan (further - the Agency according to the inventory).

2. In this Provision the following basic concepts are used:

the user of information system - state bodies and economic associations, the physical and other legal entities using information resources of information system according to the procedure, established by acts of the legislation, or by agreement of the parties;

the state register of the rights to real estate (further - the state register) - the single information database containing data on the rights to real estate, and also on owners;

the public geoportal - the web portal of information system providing use of open data;

the operator of the public geoportal - the operator of system - SUE Center of Implementation and Development of Computerization and Geoinformation Technologies under the Agency according to the inventory, responsible for uninterrupted activities of the public geoportal, its further upgrade and ensuring information security;

the technological instruction - the document approved by the operator of the public geoportal together with the Agency according to the inventory, containing procedure for electronic interaction on exchange of information with state bodies and economic associations through interdepartmental electronic requests within the public geoportal, their form and terms of provision.

3. Open data are provided according to the list according to appendix No. 1 to this Provision with observance of requirements of the laws of the Republic of Uzbekistan "About personal data" and "About protection of the state secrets".

4. Tasks of the public geoportal is rendering services to users of information system based on the Module of electronic interaction (web service) and provision of the technological instructions this by way of integration at the basis.

5. The operator of the public geoportal on the public geoportal creates the web services rendering the following services:

the technological instruction for use of the public geoportal;

viewing of open data;

loading of open data;

creation of possibility of provision of data on electronic request by permanent integration into the public geoportal according to the agreement and technological instructions.

6. Open data are provided by means of identification of the user or integration as the participant with the operator of the public geoportal based on the agreement.

7. The operator of the public geoportal records the responsibles of participants of the public geoportal and users of information system registered on the public geoportal and also performs coordination of processes of access to the public geoportal and its uses.

8. Cadastral number of the parcel of land, its location (address) and the purpose of its use constitute primary data as a part of open data which are provided to users of the public geoportal on free basis.

9. Payments for open data are made online and for accounting of payment integration with Single billing system is performed.

Chapter 2. Provision of open data to state bodies and economic associations

10. Provision of open data to state bodies and economic associations is performed according to the scheme according to appendix No. 2 to this Provision.

11. State bodies and economic associations for use of open data address the operator of the public portal.

12. The operator of the public geoportal based on request of state bodies and economic associations within one working day draws up the interdepartmental technological instruction and the agreement for permanent use of open data and information resources.

13. By provision of open data through information system economic associations provide implementation of payment in terms, established by the agreement.

Provision of open data to state bodies is performed on free basis.
