1. Approve Regulations on the information resource created by the departmental information system "Accounting of Notifications and Actions for Protection of Public Order" it (is applied).

2. To impose control over the implementation of this resolution on the Ministry of Internal Affairs.

Regulations on the information resource created by the departmental information system "Accounting of Notifications and Actions for Protection of Public Order"

I. General provisions

1. The regulations on the information resource created by the departmental information system "Accounting of Notifications and Actions for Protection of Public Order" (further - the Provision), establish procedure for the organization and functioning of information resource of the Ministry of Internal Affairs, ensuring information support of activities of the divisions of the Ministry of Internal Affairs aiming at protection of basic rights and personal freedoms through activities for maintenance, providing and recovery of procedure and public safety, and also prevention, investigation and detection of offenses and administrative offenses, regulation of security requirements of data in case of collection, accumulating, updating, storage, processing and information transfer in management.

2. For the purposes of this provision the following concepts are determined:

the administrator of information resource - division as a part of the Service of information technologies subordinated to the Ministry of Internal Affairs which directly carries out obligations of the holder and the technical administrator of the departmental information system "Accounting of Notifications and Actions for Protection of Public Order";

authentication - check of the identifier assigned to the subject of access, authenticity confirmation;

complex program and the hardware - set of the programs and technical means providing accomplishment of information processes;

identification - purpose of the identifier to subjects and access objects and/or comparison of the provided identifier with the list of the appropriated identifiers;

integrity of information - confidence, lack of contradictions and relevance of information, its protection against unauthorized destruction and change;

participants of information resource - bodies of criminal investigation, bodies of management and implementation of criminal prosecution, degrees of jurisdiction, bodies of probation and execution of criminal penalties;

data recovery - procedures for data recovery of criminal nature in condition in which they were until loss or destruction;

data storage - preserving data of criminal nature on any medium information;

material carriers - magnetic, optical, laser or other carriers of electronic information to whom it is created, fixed, transferred are accepted, stored or electronic information of criminal nature and which allow to reproduce is otherwise used and to further use this information;

management of information resource - set of the technical actions aimed at providing work of technical complex of programs and administration with information resource of automated information system;

the user - the physical person or legal entity, whose service duties assume accomplishment of actions for representation, acceptance, storage and use of information from information resource.

3. The information resource kept within the departmental information system "Accounting of Notifications and Actions for Protection of Public Order" (further - VIS of the Notification) as the specialized information resource, is intended for ensuring information support of activities of the law enforcement agencies subordinated to the Ministry of Internal Affairs in the course of maintenance, providing and recovery of public order and safety, and also in prevention, investigation and detection of offenses and administrative offenses. It is also intended for forming of digital equivalent of the case which is stored on paper format about the statement for crime execution or administrative offense, procedural documents constituted in the course of consideration to formulation of the offer on not initiation of legal proceedings or adoption of the resolution on initiation of legal proceedings or initiation of administrative process within competence of the Ministry of Internal Affairs.

4. HUNG Notifications creates single departmental environment in which data are considered correct and reliable until the return evidential information is provided.

II. The purpose and categories of the processed data

5. HUNG Notifications, being integrated with other information systems, provides safe, comprehensive and transparent information environment.

6. In VIS Notifications personal data are used only for the purpose of for which they were announced, without the aspiration to obtain information in private interests.

7. HUNG Notifications it is conducted in Romanian.

8. Accounting of information objects is provided according to provisions of the Concept of the departmental information system "Accounting of Notifications and Actions for Protection of Public Order" approved by the Order of the Government No. 34/2023, and also instructions developed by the owner of VIS of the Notification and approved together with the loggers participating in this process. In case of identification of errors or inaccuracies in the obtained documents or data the VIS administrator of the Notification shall notify on it the supplier of data HUNG of the Notification and receivers to whom malformed data were transferred.

9. If the supplier of data HUNG of the Notification makes reasonable inquiry about correction of the wrong or inexact data, the data logger makes necessary corrections in the appropriate information resource and informs on them the supplier of data who sent request.

10. Data are stored in VIS of the Notification in chronological procedure that provides possibility of receiving data for certain time period.
