About approval of the Regulations on procedure of oversight of the subjects performing functions of Central Securities Depository, the central partner, trade repository and settlement system in securities in Ukraine

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 142-1 of the Law of Ukraine "About the capital markets and the organized goods markets", the subitem 1 of Item 30 of the Section VII of the Law of Ukraine "About financial services and finance companies", for the purpose of determination of procedure of oversight of the subjects performing functions of Central Securities Depository, the central partner, trade repository and settlement system in securities in Ukraine, the Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on procedure of oversight of the subjects performing functions of Central Securities Depository, the central partner, trade repository and settlement system in securities in Ukraine (further - the Provision) which are applied.

2. To provide to the subjects performing functions of Central Securities Depository, the central partner, trade repository and settlement system in securities in Ukraine observance of requirements of the Provision.

3. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.

4. The resolution becomes effective since January 1, 2024.

I. General provisions

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About the capital markets and the organized goods markets" and determines the main organizational bases and procedure of oversight of the subjects performing functions of Central Securities Depository, the central partner, trade repository and settlement system in the securities performing activities in the territory of Ukraine (further - oversight object).

2. Terms in this Provision are used in the following values:

1) continuity of activities capability of object of oversight timely and effectively to perform/provide critical transactions / services in the normal mode of activities and in case of emergency situation;

2) the interested persons owners of object of oversight, participants and indirect participants of object of oversight, public authorities of Ukraine, clearing banks, clearing organizations, other subjects of infrastructure of the financial market;
