About approval of Administrative regulations of rendering the state services in the field of bodies of civil registration and notariate, and also on putting down of apostille on official documents

According to the Presidential decree of the Republic of Uzbekistan of December 12, 2017 No. UP-5278 "About Measures for Radical Reforming of National System of Rendering the State Services to the Population", and also for the purpose of further enhancement of system of rendering the state services in the field of bodies of civil registration and notariate the DECIDES: Cabinet of Ministers

1. Approve:

Administrative regulations of rendering the state service in issue of archive documents by departmental notarial archives according to appendix No. 3.

2. In ten-day time to provide to the Ministry of Justice of the Republic of Uzbekistan development and approval of approximate forms, forms of the documents and other acts necessary for rendering the state services, the organization and carrying out with participation of employees of the Centers of the state services of the educational seminars directed to increase in level of efficiency and effectiveness of practical application of the administrative regulations approved by this resolution.

3. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 5.

4. To the Ministry of Justice of the Republic of Uzbekistan together with the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

5. To impose control of execution of this resolution on the Minister of Justice of the Republic of Uzbekistan Davletov R. K.

Administrative regulations of rendering the state service in issue of archive documents by departmental notarial archives

Chapter 1. General provisions

1. These Regulations determine procedure for rendering to physical persons (further - applicants) the state service in issue of the duplicate of notarially processed documents, the statement from the register book of registration of notarial actions, copies of archive documents, certificates of lack of prohibition (arrest) concerning property and archive references (further - the state service).

2. The state service appears departmental notarial archives under the Ministry of Justice of the Republic of Karakalpakstan, justice departments of areas and the cities of Tashkent (further - authorized body) through the Centers of the state services or the Single portal of interactive state services of the Republic of Uzbekistan (further - EPIGU).

3. Exchange of information between centers of the state services and authorized body is performed only by means of interdepartmental electronic interaction with obligatory application of the digital signature (further - the EDS).

4. Rendering the state service is performed according to the scheme according to appendix No. 1 to these Regulations.

Chapter 2. Procedure for rendering the state service

5. The applicant for receipt of the state service addresses to the Center of the state services in attendance procedure or is registered on EPIGU for receipt of the state services in electronic form.

6. The employee of the Center of the state services on behalf of the applicant, and in case of the address through EPIGU the applicant independently in electronic form with use of the data placed on platform fills in the questionnaire for receipt of the state services in form according to appendix No. 2 to these Regulations.

7. Are applied to the questionnaire:

passport copy;

if the applicant acts on the basis of the power of attorney - the copy of the power of attorney;

in case of receipt of archive documents about the notarial operations performed on behalf of the dead - the death certificate of the dead and documents confirming the related relations of the applicant with the dead;

if the applicant is beneficiary under a will - copies of the will and the death certificate of the dead if the applicant is legal representative - the copy of the supporting document.

Copies of the documents submitted by the applicant shall be removed from originals by the staff of the Center of the state services.

In case of the address of the applicant through EPIGU originals of documents are not required. At the same time these data are checked by the staff of departmental notarial archive by means of sending an inquiry and interdepartmental electronic interaction.

8. After filling of the questionnaire the applicant checks correctness of data and certifies the questionnaire by appropriate means of identification of the signature (the EDS, dactyloscopy, the digital signature, Mobile-ID, etc.).

9. Instruction in the questionnaire of false information, and also incomplete submission of the relevant documents is the basis for refusal in provision of the state service.

The refusal in provision of the state service in other bases is forbidden.

10. Applicants have the right to refuse receipt of the state service at any stage of its rendering. In case of refusal the applicant from receipt of the state service its questionnaire is left without consideration.

11. After filling of the questionnaire with the employee of the Center of the state services and assurance by her applicant all documents electronically within 10 minutes go to authorized body.

In case of the address through EPIGU the questionnaire automatically goes to authorized body.

12. After receipt of the questionnaire by authorized body the decision on issue of the archive document or on refusal in issue in the following terms is made:

a) the duplicate of notarially processed documents - within 5 working days after receipt of the questionnaire;

b) statements from the register book of registration of notarial actions - within 2 working days after receipt of the questionnaire;

c) copies of archive documents, and also certificates of lack of prohibition (arrest) concerning property - within 2 working days after receipt of the questionnaire;

d) archive references - within 1 working day after receipt of the questionnaire.

13. In case of decision making about issue of the archive document the authorized body within 10 minutes sends to the Center of the state services the notice in electronic form with indication of payment amount for issue of the archive document and the archive document.
