1. Approve the enclosed Rules of rendering the state service "Apostilization of the Official Documents Coming from the Organizations of the Higher and (or) Postgraduate Education".

2. In the field of science and the higher education of the Ministry of science and the higher education of the Republic of Kazakhstan in the procedure established by the legislation to provide to committee on quality assurance:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of science and the higher education of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-minister of science and the higher education of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Apostilization of the Official Documents Coming from the Organizations of the Higher and (or) Postgraduate Education"

Chapter 1. General provisions

1. These rules of rendering the state service "Apostilization of the Official Documents Coming from the Organizations of the Higher and (or) Postgraduate Education" (further – the state service), are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services), the order of the Government of the Republic of Kazakhstan of April 24, 2001 No. 545 "About measures for realization of provisions of the Convention canceling the requirement of the legalization of foreign official documents made in the city of Hague on October 5, 1961" and determine procedure and conditions of putting down of apostille.

2. In these rules of rendering the state service "Apostilization of the Official Documents Coming from the Organizations of the Higher and (or) Postgraduate Education" the following determinations are used:

1) apostille – the special stamp certifying authenticity of the signature of person which signed the document, and confirmation of its powers, and also authenticity of seal or stamp which fasten this document;

2) Single contact center – the legal entity determined by authorized body in the field of rendering the state services, performing functions of directory service on provision to uslugopoluchatel of information on questions of rendering the state and other services and also to state bodies – information on questions of rendering information and communication services;

3) the subscriber structure of cellular communication – the means of communication of individual use creating signals of electric communication for transfer or acceptance of information set by the subscriber and connected to network of mobile operator, not having the permanent geographically determined location within the serviced territory, working in networks of cellular communication;

4) the National center of development of the higher education of the Ministry of science and the higher education of the Republic of Kazakhstan (further – the Center) – the operator of the state service "Apostilization of the Official Documents Coming from the Organizations of the Higher and (or) Postgraduate Education".

Primary acceptance and document handling is made for rendering the state service by the service provider by the Center.

3. The purpose of the procedure of putting down of apostille is providing guarantee of authenticity and proper execution of the apostilled documents intended for action in the territory of member countries of the Hague Convention.

4. The state service "Apostilization of the Official Documents Coming from the Organizations of the Higher and (or) Postgraduate Education" (further – the state service) appears Committee on quality assurance in the field of science and the higher education of the Ministry of science and the higher education of the Republic of Kazakhstan (further - the service provider) in c compliance these rules.

Chapter 2. Procedure for rendering the state service

5. For receipt of the state service the uslugopoluchatel submits to the service provider through the web portal of "the electronic government" (further – the portal) or through non-commercial joint-stock company "The Government for Citizens state corporation (further – the State corporation) the documents specified in Item 8 of the List of the main requirements to rendering the state service "Apostilization of the Official Documents Coming from the Organizations of the Higher and (or) Postgraduate Education" (further – the List of the main requirements) according to appendix 1 to these rules.

6. In case of documents acceptance through the State corporation the electronic receipt on acceptance of the relevant documents from the applicant in which the list of the accepted documents is specified, surname, name and middle name (in the presence) of the worker who adopted the statement, date and time of filing of application, and also date of issue of ready documents according to the address of the applicant is issued to uslugopoluchatel the receipt is issued in paper format.

7. In case of provision by uslugopoluchatel of incomplete document package and (or) documents with the expired effective period, the employee of the State corporation refuses documents acceptance and issues the receipt on refusal in rendering the state service in form according to appendix 3 to these rules with indication of date of issue.

8. The employee of department of the branches of the State corporation located in the regional centers, the cities of Astana, Almaty and Shymkent in day of receipt of documents performs preparation of documents and transfers them to the courier of the State corporation for the direction to the service provider.
