According to the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 862 "Some questions of the Ministry of transport of the Republic of Kazakhstan" of PRIKAZYVAYU:
1. Approve enclosed:

2. Recognize invalid some orders of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan according to appendix 24 to this order.
3. To provide to committee of road transport and transport control of the Ministry of transport of the Republic of Kazakhstan:
1) within ten calendar days from the date of approval of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of transport of the Republic of Kazakhstan.
4. To impose control of execution of this order on the supervising vice-Minister of Transport of the Republic of Kazakhstan.
5. This order becomes effective from the date of its signing.

Appendix 1
to the Order of the Minister of Transport of the Republic of Kazakhstan of October 10, 2023 No. 19
1. Republican public institution "Committee of rail and water transport of the Ministry of transport of the Republic of Kazakhstan" (further - Committee) is the department of the Ministry of transport of the Republic of Kazakhstan (further - the Ministry) performing regulating and realizable functions within the competence, and also participating in accomplishment of strategic functions of the Ministry in the field of rail and water transport.
2. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.
3. The committee is legal entity in form of business of public institution, has seals and stamps with the name in Kazakh, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.
4. The committee enters the civil relations from own name.
5. The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.
6. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the Chairman of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.
7. The structure and limit of the number of staff of Committee affirm according to the legislation of the Republic of Kazakhstan.
8. Committee location: Republic of Kazakhstan, 010000, city of Astana, area Esil, Prospekt Kabangbai of the batyr, 32/1, building "Transport Tower".
9. Full name of Committee:
in state language - "Kazakstan of Respublikasa Kol_k ministrl_g_n_n Tem_rzhol zhane of sou kol_g_ committee і" respublikalyk memlekettik mekemesi;
in Russian - republican public institution "Committee of rail and water transport of the Ministry of transport of the Republic of Kazakhstan".
10. This Provision is the constituent document of Committee.
11. Financing of activities of Committee is performed from the republican budget.
12. The committee is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are powers of Committee.
If legal acts grant the right to perform the activities which are bringing in incomes, then income gained from such activities go to the government budget.
13. Tasks:
1) participation in forming of state policy in the field of rail and water transport and subsequent its realization;
2) creation of conditions for ensuring requirements of economy of the republic and the population in transportations, performance of works and rendering services, and also further development of transportations and infrastructure of rail and water transport;
3) protection of the rights and legitimate interests of physical persons and legal entities, and also national interests of the state, and also creation of conditions for competition development, including in the field of international carriages.
14. Rights and obligations:

1) issues orders within the competence;
Requests 2) and receives (reports, materials) from structural divisions of the Ministry, state bodies, the organizations, their officials, physical persons and legal entities, necessary information and materials;
3) makes suggestions for improvement of the legislation of the Republic of Kazakhstan;
4) holds meetings, seminars, conferences, round tables, tenders and other actions for the questions entering competence of Committee;
5) makes offers on creation of advisory advisory bodies (working groups, the commissions, councils) on the supervised activities;
6) is checked by execution of contractual commitments and adopts acts of the rendered services;
7) performs other rights provided by the current legislation of the Republic of Kazakhstan.
Obligations:
1) ensuring realization of the tasks and functions assigned to Committee;
2) compliance with law of the Republic of Kazakhstan, it is right and protected by the law of interests of physical persons and legal entities;
3) preparation of explanations on the questions entering competence of Committee;
4) submission of required materials and references within the competence and within the legislation in case of official request for it by structural divisions of the Ministry and state bodies;
5) ensuring safety of the state-owned property which is on balance of Committee;
6) conducting financial accounting;
7) creation and provision of the accounting and financial reporting in the Ministry;
8) providing complete, timely and effective use of the budgetary funds allocated to Committee;
9) holding procedure of public procurements according to the Law of the Republic of Kazakhstan "About public procurements".
15. Functions:
1) ensuring realization of state policy within the competence;
2) participation in development, coordination and approval of regulatory legal acts within the competence;
3) providing inland waterways in navigable condition and content of locks;
4) development and coordination of technical regulations and standards;
5) coordination of standard rates of provision of the parcels of land according to project technical documentation and general schemes of development of railway tracks and railway stations;

7) development of rules of technological interaction of participants of transportation process;
8) development of the list of station ways, objects of electric utility service, the alarm system, communication, devices, the equipment, buildings, structures, constructions and other objects technologically necessary for functioning of the high-level railway system, in coordination with the state body performing management in spheres of natural monopolies;
9) development of procedure and measures of ensuring agreement obligations on the organization of transportations and (or) accomplishment of the services connected with transportation;
10) development of the freight list, subject to maintenance by the militarized protection in transit by rail;
11) development of procedure for rewarding of workers of rail transport with sign of professional difference;
12) development of procedure for provision of services of the freight forwarder;
13) development of procedure for provision of services of operators of cars (containers);
14) development of procedure for provision of services of locomotive draft;
15) development of the list of the transactions entering services of the high-level railway system in coordination with the state body performing management in spheres of natural monopolies;

20) development of the terms connected with train service;
21) development of procedure and conditions of hitching and running of railway vehicles as a part of passenger trains;
22) development of technical and technological standard expense rates of raw materials and materials, spare parts, the equipment, fuel, energy, technical losses for subjects of natural monopolies on rail transport;
23) development of the list of railway stations according to their class;
24) development of rules of providing with the militarized protection of freights in transit by rail;
25) development of the list of socially important passenger interregional traffics;
26) development of the list of the main ways entering the high-level railway system;
27) development of rules of transfer to structure of the high-level railway system of the objects constructed at the expense of means of physical persons and legal entities;
28) development of rules of the organization of transportations of passengers in interregional and international messages;
29) development of instructions for use high-level railway system;
30) development of rules of access to automated control system for passenger traffic and technological interaction under the organization of sale of travel documents (tickets);

16. Management of Committee is performed of the Chairman who bears the personal responsibility for accomplishment by Committee of the tasks assigned to it and implementation of the powers by it.
17. The chairman of Committee is appointed to position and dismissed according to the legislation of the Republic of Kazakhstan.
18. The chairman of Committee has deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.
19. Powers of the Chairman of Committee:
1) determines powers and obligations of the deputies, workers;
2) appoints to positions and dismisses employees of Committee;
3) resolves issues of sending, provision of leaves, rendering financial support, preparation (retraining), advanced training, encouragement, payment of allowances and awarding, and also disciplinary responsibility of employees of Committee;
4) represents the interests of Committee in state bodies and other organizations;
5) approves regulations on structural divisions of Committee;
