About approval of Rules of provision of the housing help

According to subitem 9-1) of article 10-2 of the Law of the Republic of Kazakhstan "About the housing relations" and the subitem 1) article 10 of the Law of the Republic of Kazakhstan "About the state services", PRIKAZYVAYU:

1. Approve Rules of provision of the housing help according to appendix 1 to this order.

2. Recognize invalid some orders according to the list according to appendix 2 to this order.

3. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of provision of the housing help

Chapter 1. General provisions

1. These rules of provision of the housing help (further - Rules) are developed according to subitem 9-1) of article 10-2 of the Law of the Republic of Kazakhstan "About the housing relations" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law) and determine procedure for purpose of the housing help to needy families (citizens).

2. In Rules the basic concepts are used:

1) The Government for Citizens State corporation (further - the State corporation) - the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services and issue of their results to uslugopoluchatel by the principle of "one window", ensuring rendering the state services electronically;

2) needy families (citizens) – persons who according to the housing legislation of the Republic of Kazakhstan have the right to the housing help;

3) comprehensive income of needy family (citizens) – the amount of the income types considered in case of purpose of the housing help;

4) the maximum permissible expense level – the relation of the maximum-permissible expense level of needy family (citizen) in month on management of object of condominium and content of common property of object of condominium, including on capital repairs of common property of object of condominium, consumption of utilities and communication services regarding increase in subscriber fee for phone connected to network of telecommunications, use of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock to comprehensive income of needy family (citizens) as a percentage;

5) the web portal of "the electronic government" – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically.

3. The state service is rendered on free basis to needy families (citizens) (further – uslugopoluchatel). Purpose of the housing help (further – the state service) appears local executive bodies of the cities of Astana, Almaty and Shymkent, areas and cities of regional value (further – the service provider).

The housing help is provided at the expense of means of the local budget to the uslugopoluchatel who are constantly registered and living in the dwelling which is on the property right as the single dwelling in the territory of the Republic of Kazakhstan, and also to employers (subtenants) of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock on payment:

expenses on management of object of condominium and content of common property of object of condominium, including capital repairs of common property of object of condominium;

consumption of utilities and communication services regarding increase in subscriber fee for phone connected to network of telecommunications;

expenses for use of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock.

The expenses of uslugopoluchatel accepted to calculation of the housing help are determined as expense amount by each of the above-stated directions.

The housing help is determined as difference between payment amount of expenses on management of object of condominium and content of common property of object of condominium, including capital repairs of common property of object of condominium, consumption of utilities and communication services regarding increase in subscriber fee for phone connected to network of telecommunications, use of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock and the maximum permissible expense level of uslugopoluchatel on these purposes established by local representative bodies, no more than 10 percent.

4. Housing help is given on the accounts shown by suppliers about monthly fees on management of object of condominium and content of common property of object of condominium, including capital repairs of common property of object of condominium according to expense budget and invoices for payment of utilities at the expense of budgetary funds to uslugopoluchatel. The size and procedure for rendering the housing help are determined by local representative bodies of the cities of republican value, the capital, areas, cities of regional value according to Item 5 of article 97 of the Law of the Republic of Kazakhstan "About the housing relations".

5. Uslugopoluchatel (or his representative owing to the power based on the power of attorney, the legislation, the judgment or the administrative act) addresses for purpose of the housing help once a quarter in the State corporation or the web portal of "the electronic government".

Chapter 2. Procedure for purpose of the housing help

6. Uslugopoluchatel for receipt of the state service sends to the Service provider through the web portal of "the electronic government" or the State corporation the statement for purpose of the housing help, in form according to appendix 1 to these rules.

The list of the main requirements to rendering the state service "Purpose of the Housing Help" is provided in appendix 2 to these rules.

For purpose of the housing help the uslugopoluchatel (or his representative under the notarized power of attorney) provides documents according to Item 8 of the List of the main requirements to rendering the state service.
