1. Approve the enclosed rules of rendering the state service "Licensing for Export and (or) Import of Separate Types of Goods in case of Introduction of Quantitative Restrictions (Quotas)" according to appendix to this order;

2. To provide to committee of fishery of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication;

3. To impose control of execution of this order on the supervising vice-Minister of Ecology and Natural Resources of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Licensing for Export and (or) Import of Separate Types of Goods in case of Introduction of Quantitative Restrictions (Quotas)"

Chapter 1. General provisions

1. These rules of rendering the state service "Licensing for Export and (or) Import of Separate Types of Goods in case of Introduction of Quantitative Restrictions (Quotas)" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for rendering the state service "Licensing for Export and (or) Import of Separate Types of Goods in case of Introduction of Quantitative Restrictions (Quotas)" (further – the state service).

2. In these rules the following basic concepts are used:

1) the transport signature – the digital signature used for ensuring integrity and authorship of the transferred messages in case of information exchange of information systems using the WSSecurity specification;

2) participants of foreign trade activity (further – uslugopoluchatel) – the physical persons performing foreign trade activity including registered as individual entrepreneurs according to the legislation of the Republic of Kazakhstan and the legal entities created according to the legislation of the Republic of Kazakhstan, and also the organization not being legal entities;

3) the web portal of "the electronic government" (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

4) payment gateway of "the electronic government" (further – PShEP) – the object of informatization automating processes of information transfer about carrying out payments within rendering the paid services rendered electronically.

3. Quantitative restrictions (quotas) are introduced by authorized body in the field of protection, reproduction and use of fauna according to article 18 of the Law "On Regulation of Trading Activity".

Chapter 2. Procedure for rendering the state service

4. The state service appears Committee of fishery of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan (further – the service provider)

5. The list of the main requirements to rendering the state service "Licensing for Export and (or) Import of Separate Types of Goods in case of Introduction of Quantitative Restrictions (Quotas)" is specified in appendix 1 to these rules (further – the List).

6. Uslugopoluchatel sends to the service provider by means of the portal the documents specified in Item 8 of the List.

Reclamation from uslugopoluchatel of documents which can be received from information systems is not allowed.

Information exchange of the portal and information systems is performed according to article 43 of the Law of the Republic of Kazakhstan "About informatization".

7. The state information system of permissions and notifications completely automatically processes and creates result of rendering the state service in the statement of uslugopoluchatel within 1 (one) working day without participation of the service provider by signing of result of rendering the state service by the transport signature.

8. The result of rendering the state service goes to uslugopoluchatel to "personal account" on the portal in electronic form, certified by the transport signature, in form according to appendices 3 and 4 to these rules.

9. The refusal in licensing to uslugopoluchatel is performed on the bases specified in Item 9 of the List.

10. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the subitem 11) of Item 2 of article 5 of the Law on the state services.
