About approval of Licensed conditions of implementation of economic activity on management of dangerous wastes

According to part one Item 14-1 of Article 7, of paragraph one of part two of article 9 of the Law of Ukraine "About licensing of types of economic activity", "About Waste management" the Cabinet of Ministers of Ukraine decides parts one of article 44 of the Law of Ukraine:

1. Approve Licensed conditions of implementation of economic activity on management of the added dangerous wastes.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

3. This resolution becomes effective from the date of its publication, except Items 1, of the 5th list of resolutions of the Cabinet of Ministers of Ukraine, invalid, approved by this resolution which become effective since January 9, 2024.

Licensed conditions of implementation of economic activity on management of dangerous wastes

General provisions

1. These Licensed conditions establish the exhaustive list of the documents enclosed to the application for receipt of the license for implementation of economic activity on management of dangerous wastes (further - the license), and also determine the exhaustive list of organizational, personnel, production requirements, mandatory during implementation of such activities.

These Licensed conditions do not extend to licensing of economic activity on transportation of dangerous wastes.

2. Action of these Licensed conditions extends to all subjects of managing irrespective of their form of business and pattern of ownership which in full or partially perform or intend to perform economic activity on management of dangerous wastes.

3. In these Licensed conditions terms are used in such value:

economic activity on management of dangerous waste complexes of transactions on collection and processing of dangerous wastes, and also collection, storage of dangerous wastes for their further export for the purpose of processing or removal;

policy tools of economic activity on management of dangerous waste equipments, the equipment, cargo handling machinery, containers and other means which are in property or use of the licensee and necessary for the organization of implementation of the activities which are subject to licensing;

storage of dangerous waste contents of waste on objects of collection, in particular before their processing, no more than one year from the moment of their education that is safe for human health and the surrounding environment according to ecological and sanitary and hygienic requirements;

collection of dangerous waste transactions, consisting in withdrawal, purchase, accumulating and storage of dangerous wastes by subjects of managing in the field of waste management, including separate collection for the purpose of further transportation of dangerous wastes on objects of processing of dangerous wastes.

Other terms are used in the value given in the Law of Ukraine "About licensing of types of economic activity" (further - the Law), the Law of Ukraine "About waste management", the resolution of the Cabinet of Ministers of Ukraine of October 11, 2021 No. 1065 "About the single ecological Ecosystem platform (The Official Bulletin of Ukraine, 2021, No. 82, the Art. 5264).

4. Content and forms of statements for obtaining, renewal, cancellation of the license, suspension or renewal of action of the license, of expansion or narrowing of type of economic activity on management of dangerous wastes, the data and the description of the documents enclosed to the corresponding applications are given in appendices to these Licensed conditions.

5. After establishment of compliance of the material and technical resources necessary for implementation of economic activity on management of dangerous wastes (further - economic activity), authorized persons of Mindovkolya the license applicant (licensee) for receipt of the license or expansion of implementation of type of economic activity gives electronically by use of management information system waste (further - system), being the functional module of the Single ecological Ecosystem platform, the documents provided by appendices 1-10, 12 and created automatically by system software on the basis of information which was entered by the license applicant (licensee) during creation of accounting record in system and/or submission of documents electronically in system and filling of all obligatory fields. The documents existing only in paper form are enclosed to the application in the PDF format with imposing on them the digital signature based on the qualified certificate.

In case of submission of documents in paper form the license applicant (licensee) for receipt of the license or expansion of implementation of type of economic activity submits to body of licensing the application for receipt of the license or expansion of implementation of type of economic activity in form according to appendices 1 and 2.

6. The following documents certified by the signature of the license applicant (licensee) or other authorized person are attached to the statement for receipt of the license or expansion of implementation of type of economic activity:

1) the passport copy of the citizen of Ukraine the head of the license applicant (or its authorized person) with mark of monitoring body concerning the message on refusal from - for the religious beliefs from adoption of registration number of accounting card of the taxpayer (moves only physical persons entrepreneurs who because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and reported about it to the relevant monitoring body);

2) the description of the documents enclosed to the application for receipt of the license or expansion of implementation of type of economic activity, in duplicate (in case of submission of documents in paper form in form according to appendix 3);
