About approval of the Regulations on the cable sewerage of electronic communication networks

According to part four of article 34 of the Law of Ukraine "About electronic communications", subitems "k" and "l" of Item of 1 part four of article 4 of the Law of Ukraine "About the National commission performing state regulation in spheres of electronic communications, radio-frequency range and provision of services of mail service" the National commission performing state regulation in spheres of electronic communications, radio-frequency range and provision of services of mail service DECIDES:

1. Approve the enclosed Regulations on the cable sewerage of electronic communication networks.

2. Declare invalid the decision of the National commission performing state regulation in the sphere of communication and informatization of August 23, 2012 No. 428 "About approval of Rules of provision in the use of the cable sewerage of telecommunication and recognition invalid decisions of NKRS of 23.07.2009 No. 1607" registered in the Ministry of Justice of Ukraine on September 12, 2012 at No. 1571/21883.

3. To submit to department of electronic communications in the procedure established by the legislation this resolution on state registration to the Ministry of Justice of Ukraine.

4. This resolution becomes effective from the date of its official publication.

Regulations on the cable sewerage of electronic communication networks

I. General provisions

1. This Provision establishes:

rules of provision and receipt of access to the cable sewerage of electronic communication networks (dalee-KKE);

rules of provision in use of KKE.

2. Action of this provision extends to activities of operators of electronic communications who are owners of KKE, and suppliers of electronic communication networks and/or services which use KKE for own needs or for provision of electronic communication services.

3. In this Provision terms are used in the following values:

booking of the place in KKE-service of the supplier which consists in fixing to the customer, in its separate address, places in KKE channel for further use according to terms of the contract about access and use of KKE (further - the Agreement);

free reservoir KKE channel KKE-svobodnaya Ploshchad which is not provided by the supplier for own use is not reserved and is not used by other customers, taking into account load of KKE channel, is available to laying of cables of electronic communications at the time of laying of cable by the customer;

the site the KKE-part of KKE between two or more viewing devices, two addresses, the coupling and the address, two couplings;

access to KKE-provision to the customer of the right and possibility of use of KKE of the supplier based on the signed Agreement;

permission to work in KKE-pismenny or the electronic document signed by the supplier who submits the right to the customer within agreed time frame to perform works in KKE of the supplier;

replacement of cable replacement of the cable of electronic communications of the customer laid in KKE by other cable having the same or other diameter and length on KKE sites;

the customer supplier of electronic communication networks and/or services who receives/plans to get at the supplier access to infrastructure of KKE and/or use of KKE on contractual conditions;

infrastructure the KKE-equipment and constructions intended for laying, installation and operational servicing of cables of the electronic communications which are turning on pipelines (channels of the cable sewerage), mortgage and viewing devices in wells, cable cases, mines, collectors, bridges, platforms, tunnels, buildings and also the rooms for input of cables and placement of the linear equipment provided or can be provided by the owner of KKE in use to the customer on contractual conditions;

cartogram - the geographical (schematic) card of certain territory on which the scheme (route) of laying of cables of electronic communications on the respective site (sites) with indication of cable wells (viewing devices), distance between them, names of streets, other additional information is designated;

use KKE-service of the supplier in provision to the customer in use of the place in KKE channel for placement of the laid cable of electronic communications of the customer on contractual conditions;

provision of the place in the channel KKE-service in allocation in use to the customer of the place in KKE channel for the purpose of further laying of cable of electronic communications of the customer;

planned operational works - installation, repair work and works on maintenance of cables of electronic communications, including laying of cables and installation of couplings, replacement or dismantle of the existing cables and/or recovery of condition of infrastructure of KKE;

coordination of the working project service of the supplier which is provided according to the address of the customer and consists in check of compliance of the project documentation to the issued specifications (dalee-TU);

unplanned operational works - the recovery repair work connected with accident elimination of cables of electronic communications and cable couplings and/or infrastructures of KKE;

the supplier is operator of electronic communications who is the owner of KKE and can provide services of access and/or service of use of KKE which is in its ownership;

damage the KKE-condition of KKE when the variation from normative and technical condition which created accident on electronic communication network or creating prerequisites for its origin takes place;

the development and issue of TU service provided by the supplier according to the separate address of the customer, providing issue of basic data for accomplishment of project works on laying/replacement of cables of electronic communications for receipt of access to KKE and its use;

technical supervision service of the supplier which consists in provision to the customer (the customer's contractor) of permission to work in KKE and implementation of supervision of carrying out preliminary examination, accomplishment of planned and/or unplanned operational works, including with confirmation of the route, diameter, type, length of the site, channel of arrangement, and so forth.
