Based on part (6) article 3 of the Law No. 420/2006 on technical regulation (repeated publication: The official monitor of the Republic of Moldova, 2017, Art. No. 92-102, 125), with subsequent changes, DECIDES: the Government

1. Approve the Technical regulation about marking of the materials applied in case of production of the main components of the footwear intended for realization to consumers it (is applied).

2. This resolution becomes effective after 12 months from the date of publication in the Official monitor of the Republic of Moldova.

The technical regulation about marking of the materials applied in case of production of the main components of the footwear intended for realization to consumers

This resolution shifts the Directive 94/11/EC of the European Parliament and Council of March 23, 1994 for approach of legislations of state members concerning marking of the materials applied to the main components of the footwear intended for realization to the consumer published in the Official magazine of the European Union by L 100 of April 19, 1994 with the last amendments made by the Directive 2013/15/EU of Council of May 13, 2013 published in the Official magazine of the European Union by L 158 of June 10, 2013.

I. Scope and determinations

1. This Technical regulation establishes rules on marking of the materials used in case of production of the main components of shoe products held for sale to consumers.

2. For the purposes of this Technical regulation footwear is understood as all products with superimposed soles intended for covering or protection of foot including their components sold separately, provided in appendix No. 1.

3. The incomplete list of shoe products which are subject of this Technical regulation is provided in appendix No. 2.

4. Are not marking subject according to this Technical regulation:

1) the second-hand footwear which was in use;

2) protective footwear which falls under action of the Technical regulation about individual protection equipment approved by the Order of the Government No. 108/2022;

3) footwear in which production harmful chemicals are used, according to the Law No. 277/2018 on the chemicals hazardous to health and prohibited for sale;

4) toy footwear.

II. Requirements and free turnover

5. The footwear and shoe products entered and/or put on the market shall conform to the requirements of marking established by this Technical regulation.

6. In case of introduction on the market of the footwear which is not corresponding to regulations on marking the measures provided by the Law No. 162/2023 on supervision of the market and products compliance are applied.

7. Introduction on the market of the footwear conforming to the requirements of marking established by this Technical regulation cannot be forbidden or limited.

III. Information specified on the label for informing consumers

8. Information on structure of shoe products is given by means of labels according to Items 13-18.

9. Labels contain information concerning three components of shoe products as they are determined in appendix No. 1, respectively:

1) person (top);

2) liner and insole;

3) outside sole.

10. The composition of the materials used in case of production of the main components for shoe products is designated by pictograms or the written text in Romanian, without excluding text designation in other foreign languages, according to appendix No. 1.

11. In case of the upper part classification of the used materials is established based on provisions of Item 13 and appendix No. 1, without accessories or strengthenings, such as stripes for protection of anklebone, borders, jewelry, buckles, cringles or other similar accessories.

12. In case of external sole classification of the used materials is established proceeding from amount of the materials containing in it, according to Items 13-18.

13. Labels shall contain information concerning the material classified according to appendix No. 1, which constitutes at least 80% of surface of the upper part, liner and insole, respectively 80% of amount of outside sole. If any of materials does not constitute 80% of product, footwear two the main components of material are specified.

14. Information on structure shall be provided on footwear. The producer or his authorized representative, the legal entity, with the location in the Republic of Moldova, can choose either pictograms, or the designations written at least in Romanian as it is determined and shown in appendix No. 1.

15. Marking assumes drawing information provided by it at least on one product of pair of shoes by printing, gluing, stamping or attachment of the label.

16. Marking shall be visible, well put and available and shall not mislead consumers, and pictograms shall be rather big in order that the containing information could be understood easily.

17. The producer or his authorized representative, the legal entity with the location in the Republic of Moldova, bears responsibility for delivery of labels for shoe products and for reliability of the provided information.

18. If the producer or his authorized representative are not in the territory of the Republic of Moldova, the responsibility provided in Item 17, is assigned to the importer. The retail dealer bears responsibility for availability on the footwear of the corresponding marking provided by this Technical regulation realized by it.

19. Information required according to this Technical regulation if necessary can be added with information placed on the label in the form of the text.
