About introduction of marking of separate types of dairy products means of identification

According to item 4 of article 7 of the Agreement on marking of goods means of identification in the Eurasian Economic Union of February 2, 2018 (further - the Agreement) Council of the Eurasian economic commission solved:

1. State members of the Eurasian Economic Union (further - state members) independently determine Date of Introduction and procedure for marking by means of identification (further - marking) separate types of dairy products (further - goods) in the territory according to this Decision and notify the Eurasian economic commission on such date not later than 6 months before its approach. At the same time the prohibition on input cannot be introduced into circulation of unmarked goods before the terms established in the inventory, which are subject to marking by means of identification approved by this Decision (further - the list).

2. Determine that:

the goods included in the list are subject to marking;

marking of goods is performed by means of identification which are applied on consumer and group packagings of dairy products and which correspond to the characteristics approved by this Decision;

multiple package of dairy products - the packaging combining certain quantity of interior packages of one goods marked by means of identification which can be also implemented to the consumer. The multiple package of dairy products is disbanded in case of withdrawal at least of one commodity unit from it. Interior packages are removed from turnover in case of realization of the multiple package combining them along with conclusion from turnover of multiple package;

interior package - packaging, held for sale or primary package of products, implemented together with products;

dairy products in amount of 20 liters both more or weighing 20 kilograms and more in the packaging intended for repeated application (multiturnover packaging) are not subject to marking before its packing in interior package by industrial method;

dairy products which net weight constitutes 30 grams and less, the dairy products packed by nonindustrial method in retail link baby food for children up to 3 years both specialized dietary clinical and dietary preventive foods are not subject to marking;

set of goods - the set of goods created by the participant of turnover of dairy products including the marked dairy products combined by general interior package having general means of identification (means of identification of set of goods) and which is subject to realization (sale) with possibility of its disbandment. In case of realization of set of goods along with conclusion the marked dairy products included in such set of goods are removed from turnover of set of goods of turnover. In case of disbandment of set of goods of the data on its disbandment are fixed in national component of information system of marking of goods, and the marked dairy products included in such set of goods are introduced into circulation;

marking of remaining balance of the goods included in the list is not performed, stay terms in turnover of unmarked goods are determined by the legislation of state member;

state members for the purpose of ensuring functioning of information system of marking of goods determine national operators (administrators) of national components of information system of marking of goods;

interaction of state members is performed according to basic technology organizational model of coding system of goods means of the identification in the Eurasian Economic Union approved by the Decision of Council of the Eurasian economic commission of March 5, 2021 No. 19;

paragraphs the twelfth - the sixteenth voided;

state members which entered marking in the territory provide cryptographic protection of means of identification according to Item 1 of the Decision of Council of the Eurasian economic commission of April 23, 2021 to No. 41 "About single mechanisms of cryptographic protection when marking goods means of identification in the Eurasian Economic Union";

3. Approve enclosed:

the inventory, subject to marking by means of identification;

characteristics of means of identification of goods, requirements to structure and structure of information containing in means of identification of goods, procedure for generation and drawing such means of identification;

requirements to format, structure and structure of data on the marked goods transferred between competent (authorized) bodies of state members of the Eurasian Economic Union and between competent (authorized) bodies of state members and the Eurasian economic commission and also to terms of transfer of such data;

the minimum scope of information about the marked goods, the goods containing in information system of marking, access to which is provided to consumers and other interested persons, including by means of information services as a part of national components and integration component of information system of marking of goods.

4. This Decision becomes effective after 30 calendar days from the date of its official publication.
