AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN AND GOVERNMENT OF GEORGIA

of March 6, 2007

About the international automobile communication

(Protocol as amended of 15.05.2019)

The government of the Republic of Kazakhstan and the Government of Georgia which are hereinafter referred to as by "Parties"

being guided by need of further development of cooperation between the states of the Parties in the field of the international automobile communication,

aiming to facilitate implementation of automobile communication between the states of the Parties and transit across their territories,

agreed as follows:

Article 1. Sphere

1. The parties agreed based on this agreement and according to national legal systems of the states to promote cooperation in the field of automobile communication, to development of bilateral and transit motor transportation transportations of passengers and loads between the states of the Parties and en route through their territories, and also to the third states or / from the third states and for these purposes determining procedure of the specified transportations.

2. Specified in Item 1 of this Article are transported by the vehicles registered in the territory of one of the states of the Parties (including automobile vehicles) on the roads open for the international automobile communication.

3. This agreement does not affect the rights and obligations of the states of the Parties following from other international agreements.

Article 2. Determinations

For the purposes of interpretation of provisions of this agreement the following terms mean:

"Carrier" means any physical person or legal entity registered in the territory of the state of one of the Parties which according to the national legal system of the state performs passenger or freight transportation for remuneration or on hiring.

"The state the founder" means the state territory of the Party in which the carrier is founded.

"Cabotage" means the transportations performed between the Items located in the territory of the state of one of the Parties the carrier founded in the territory of the state of other Party.

"Competent authority" means:

for the Kazakhstan Side - the Ministry of the industry and infrastructure development of the Republic of Kazakhstan;

for the Georgian Side - the Ministry of Economy and Sustainable Development of Georgia and/or the Agency of the land transport or other bodies responsible for road transport.

In case of change of the name or functions of the above-named competent authorities of the Party will be timely notified through diplomatic channels.

"Trail car" means the vehicle which is not equipped with the engine and intended for movement in structure with the motorized vehicle.

"Semitrailer truck" means trail car which is attached to the vehicle in such a way that its front part relies on it and certain part of the load which is on it is the share of the vehicle.

"Permission" means the document issued by competent authorities of the Parties which grants the right to the vehicles registered in the territory of the state of other Party to transport passengers and loads on or through the territory of the state of the Party which issued permission.

"Registration" are meant by assignment, according to the existing national legal systems of the states determined by the relevant competent authorities of identification number to the vehicle. In case of combination of vehicles, the vehicle represents priority factor for issue of permission or release from it.

"Regular transportations of passengers and baggage" means the transportations of passengers performed with certain regularity and along in advance determined route with indication of stop Items for landing and disembarkation of passengers, to the schedule of movement of buses along route and rates.

"Irregular transportations of passengers and baggage" means passenger traffic in case of which conditions of their implementation are determined in each separate case by approval between the customer and carrier.

"Vehicle" means the vehicle:

a) separately taken or combination of vehicles;

b) intended for passenger (more than 9 passengers, including voditelyaavtobus are designed and intended for transportation) and freight transportation, being in ownership of carrier in the form of property, hiring or owing to the leasing contract.

c) cars.

"Transit" means transportation of goods (without loading and unloading) and transportation of passengers (without landing and disembarkation) which is performed by the carrier founded in the territory of the state of one of the Parties, driving through the territory of the state of other Party to the third country or back.

"Dangerous goods" means substances and/or products which according to the international standards on type of danger are classified on 9 classes and which international motor transportation according to the European agreement on the international road carriages of dangerous goods (ADR) is prohibited or is allowed to it with observance of certain conditions.

"Special permission" - the document granting to carrier the right of accomplishment of transportations of bulky, heavy and dangerous goods on the vehicle according to the national legal system of the state of the Party on which territory it is transported.

Article 3. General provisions

1. Transport drivers of the states of the Parties shall have national or international car driver licenses, the corresponding categories of the vehicles managed by them.

2. Permission and other documents which are required according to this agreement shall be at the transport driver and be shown upon the demand of the competent authorities which are acting on the basis of the national legal system of the state.

3. The transportations of passengers and loads performed based on this agreement are performed on condition of obligatory civil liability insurance of owners of vehicles for the damage caused to the third parties. The carrier shall insure each vehicle which is carrying out the specified transportations in advance.

4. Border, transport, sanitary and quarantine, veterinary and phytosanitary control and carrying out customs clearance when transporting persons needing urgent medical care and also when transporting animal and perishable loads are performed out of turn.

5. For the purpose of ensuring accomplishment of this agreement competent authorities of the states of the Parties mutually communicate about all changes of national legal systems of their states influencing implementation of this agreement.

Article 4. Regular transportations of passengers and baggage

1. Regular transportations of passengers and baggage are performed based on permissions.

2. Permissions are not required on regular transit transportations of passengers and baggage.

3. Permissions to regular passenger traffic are issued based on the request sent by carrier to competent authority of the country of its registration with application of documents according to the existing national legal system of the country and the following documents:

a) schemes of regular route;

b) schedules of movement of the bus(es) along regular route with indication of:
