AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF BELARUS AND GOVERNMENT OF THE RUSSIAN FEDERATION

About cooperation in the field of transportation of nuclear materials

The government of the Republic of Belarus and the Government of the Russian Federation which further are referred to as with the Parties

aiming at further development of cooperation in the field of use of atomic energy in the peace purposes,

in view of need of transportation of the heat-generating assemblies, the irradiated heat-generating assemblies of the nuclear reactors and radioactive waste formed in case of conversion of the irradiated heat-generating assemblies of nuclear reactors between the Republic of Belarus and the Russian Federation,

considering that the Republic of Belarus and the Russian Federation are participants of the Vienna convention on the civil responsibility for nuclear damage of May 21, 1963, Conventions on the operational notification on nuclear accident of September 26, 1986, Conventions on the help in case of nuclear accident or radiation emergency of September 26, 1986 and the Integrated convention on safety of the treatment of the fulfilled fuel and on safety of the treatment of radioactive waste of September 5, 1997,

in view of provisions of the Convention on physical protection of nuclear material and nuclear installations of October 26, 1979,

in view of applicable international agreements and the legislation of each of the states of the Parties in the field of transportation of the heat-generating assemblies, the irradiated heat-generating assemblies of the nuclear reactors and radioactive waste formed in case of conversion of the irradiated heat-generating assemblies of nuclear reactors agreed as follows:

Article 1

For the purposes of this agreement the used terms have the following value:

"the heat-generating assembly" - the machine-building product containing nuclear materials and intended for receipt of heat energy in the nuclear reactor due to implementation of controlled nuclear reaction, made in the Russian Federation and delivered for the nuclear power plant built in the territory of the Republic of Belarus according to the Agreement between the Government of the Republic of Belarus and the Government of the Russian Federation on cooperation in construction in the territory of the Republic of Belarus of nuclear power plant of March 15, 2011;

"the irradiated heat-generating assemblies of the nuclear reactor" - the heat-generating assemblies of the Russian production irradiated in the nuclear reactor of the nuclear power plant built in the territory of the Republic of Belarus according to the Agreement between the Government of the Republic of Belarus and the Government of the Russian Federation on cooperation in construction in the territory of the Republic of Belarus of nuclear power plant of March 15, 2011, and taken from it, containing spent nuclear fuel;

"radioactive waste" - the materials and substances formed in case of conversion of the irradiated heat-generating assemblies of nuclear reactors which are not subject to further use;

"accompanying persons" are the persons designated by authorized organization and performing maintenance of the heat-generating assemblies, the irradiated heat-generating assemblies of nuclear reactors and radioactive waste in case of their transportation on the territories of the states of the Parties.

Article 2

The parties cooperate in area of transportation of the heat-generating assemblies and radioactive waste from the Russian Federation to the Republic of Belarus, and also the irradiated heat-generating assemblies of nuclear reactors from the Republic of Belarus to the Russian Federation.

Import conditions to the Russian Federation of the irradiated heat-generating assemblies of nuclear reactors for the subsequent conversion, and also return to the Republic of Belarus of radioactive waste are determined by the Parties in the free standing agreement determining such conditions which will become effective before the first transportation of the corresponding irradiated heat-generating assemblies of nuclear reactors.

Transportation of the heat-generating assemblies, the irradiated heat-generating assemblies of nuclear reactors and radioactive waste is performed in the presence of agreements (contracts) signed by authorized organizations of the Republic of Belarus and authorized organizations of the Russian Federation (further - agreements (contracts)) according to the national legal system of each of the states of the Parties and international treaties which participants are the Republic of Belarus and the Russian Federation, taking into account provisions of this agreement.

For transportation of the heat-generating assemblies, the irradiated heat-generating assemblies of nuclear reactors and radioactive waste the Belarusian Side recognizes certificates permissions on the design and transportation of packaging issued in the procedure established by the legislation of the Russian Federation.

Article 3

For the purpose of accomplishment of this agreement of the Party appoint competent authorities:

from the Belarusian Side - the Department of Energy of the Republic of Belarus;

from the Russian Side - State Atomic Energy Corporation "Rosatom".

The Belarusian Side appoints the Belarusian authorized organizations. The competent authority of the Russian Side appoints the Russian authorized organizations.

Competent authorities of the Parties notify each other in writing on replacement or appointment of new authorized organizations.

Article 4

Transportation of the heat-generating assemblies, the irradiated heat-generating assemblies of nuclear reactors and radioactive waste on the territories of the states of the Parties is performed by rail transport in the through international traffic.

Authorized organizations inform each other in writing on transportation of the heat-generating assemblies, the irradiated heat-generating assemblies of nuclear reactors and radioactive waste not later than 60 calendar days before start date of transportation.

Any transportation of the heat-generating assemblies, the irradiated heat-generating assemblies of nuclear reactors and radioactive waste is performed on condition of receipt of the written confirmation by authorized organization from other authorized organization about readiness to accept load. Such confirmation shall be received by the consignor from the consignee not later than 20 calendar days before start date of transportation. The procedure and form of provision of such confirmation are determined in the relevant contract (contract) between authorized organizations taking into account provisions of this agreement.

Article 5

Maintenance of the heat-generating assemblies, the irradiated heat-generating assemblies of nuclear reactors and radioactive waste in transit on the territories of the states of the Parties if such maintenance is necessary according to the national legal system of each of the states of the Parties, is performed by accompanying persons.
