About approval of Rules of implementation of the state monitoring of condition of subsoil and monitoring of condition of subsoil on the subsoil plot provided in use

(as amended of the Order of the Government of the Russian Federation of 14.03.2024 No. 300)

According to article 36.2 of the Law of the Russian Federation "About subsoil" the Government of the Russian Federation decides:

1. Approve the enclosed Rules of implementation of the state monitoring of condition of subsoil and monitoring of condition of subsoil on the subsoil plot provided in use.

2. The conclusion of agreements on information exchange, the stipulated in Item 11 Rules approved by this resolution is performed no later than December 1, 2024.

3. This resolution becomes effective since September 1, 2024.

The rules approved by this resolution are effective till September 1, 2030.

Rules of implementation of the state monitoring of condition of subsoil and monitoring of condition of subsoil on the subsoil plot provided in use

I. General provisions

1. These rules establish procedure of the state monitoring of condition of subsoil (further - the state monitoring) and monitoring of condition of subsoil on the subsoil plot provided in use (further - local monitoring).

2. The state monitoring represents system of regular observations of condition of subsoil and the processes happening in them, assessment and the forecast of changes of condition of subsoil under the influence of natural and (or) anthropogenous factors.

3. The state monitoring is part of the state environmental monitoring (the state monitoring of the environment).

4. The state monitoring is performed by bodies and the organizations, stipulated in Item 2 articles 36.2 of the Law of the Russian Federation "About subsoil".

The public institutions subordinated to Federal Agency for Subsoil Management perform the state monitoring based on the state task.

The public institutions subordinated to Federal Agency for Subsoil Management, when implementing the state monitoring have the right to attract contractors under the contracts signed according to the Federal Law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs".

Public authorities of subjects of the Russian Federation with participation in implementation of the state monitoring have the right to attract the public institutions created by the subject of the Russian Federation and (or) contractors under the contracts signed according to the Federal Law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs".

5. The Federal Agency on Mineral Resources, its territorial authorities and public institutions subordinated to it perform the state monitoring based on the following data:

a) the data received as a result of the activities;

b) geological information on subsoil;

c) the data received from other state bodies and their subordinated organizations, public authorities of subjects of the Russian Federation, legal entities and physical persons;

d) data of remote sensing of Earth from space.

6. Objects of the state monitoring is subsoil in the territory of the Russian Federation, in exclusive economic zone of the Russian Federation, on the continental shelf of the Russian Federation, including within the Russian sector of bottom of the Caspian Sea, in the Black and Azov seas within which the Russian Federation performs sovereignty, the sovereign rights or jurisdiction in connection with acceptance to the Russian Federation of the Republic of Crimea and education as a part of the Russian Federation of new subjects - the Republic of Crimea and the federal city of Sevastopol, the processes happening in them, and also underground waters.

The state monitoring is carried out on not used parts of subsoil within the territory of the Russian Federation, in exclusive economic zone of the Russian Federation, on the continental shelf of the Russian Federation, including within the Russian sector of bottom of the Caspian Sea, in the Black and Azov seas within which the Russian Federation performs sovereignty, the sovereign rights or jurisdiction in connection with acceptance to the Russian Federation of the Republic of Crimea and education as a part of the Russian Federation of new subjects - the Republic of Crimea and the federal city of Sevastopol, and can be carried out on the subsoil plots provided in use in case of carrying out by public institutions of planned hydrogeological and engineering-geological inspections subordinated to Federal Agency for Subsoil Management for verification of data of the local monitoring performed by the subsoil user and also in cases of use of wells of subsoil users as Item of observations of the state basic supervisory network.

7. The purposes of the state monitoring are:

a) identification, assessment and forecasting of changes of condition of subsoil under the influence of natural and (or) anthropogenous factors;

b) assessment and forecasting of changes of condition of underground waters;

c) providing public authorities, local government bodies, legal entities and physical persons with information on condition of subsoil and the processes happening in subsoil, and also information on condition of underground waters.

8. The state monitoring is performed on the basis of observations with use technical and the software providing compatibility of data, stipulated in Item 5 these rules, among themselves and also with data of other types of monitoring which are parts of the state environmental monitoring (the state monitoring of the environment) and local monitoring.

Methodical ensuring the state monitoring is performed by Federal Agency for Subsoil Management.

9. The state monitoring includes:

a) monitoring of underground waters;

b) monitoring of dangerous exogenous geological processes;

c) monitoring of dangerous endogenous geological processes;

d) monitoring of condition of subsoil, including in internal sea waters, in the territorial sea, in exclusive economic zone of the Russian Federation, on the continental shelf of the Russian Federation, including within the Russian sector of bottom of the Caspian Sea, in the Black and Azov seas within which the Russian Federation performs sovereignty, the sovereign rights or jurisdiction in connection with acceptance to the Russian Federation of the Republic of Crimea and education as a part of the Russian Federation new subjects - the Republic of Crimea and the federal city of Sevastopol.

10. The Federal Agency on Mineral Resources, its territorial authorities and public institutions subordinated to it when implementing the state monitoring interact in the form of representation and (or) receipt of information with the following federal executive bodies and the organizations:
